These findings are incorporated by reference herein. <br />(2) To the greatest possible degree, necessary and adequate public access <br />will be provided along the Willamette River by appropriate legal means. <br />Findings of fact that address this standard are described under Criterion E for Development Within <br />Willamette Greenway Boundaries. These findings are incorporated by reference herein. <br />(3) The intensification, change of use, or development will conform with <br />applicable Willamette Greenway policies as set forth in the Metro Plan. <br />Findings of fact that address this standard are described under Criteria A-E for Development <br />Within Willamette Greenway Boundaries. These findings are incorporated by reference herein. <br />(4) In areas subject to the Willakenzie Area Plan, the intensification, change <br />of use, or development will conform with that planÈs use management <br />considerations. <br />The subject site is not within the boundaries of the Willakenzie Area Plan. Therefore, this criterion <br />is not applicable. <br />(5) In areas not covered by subsection (4) of this section, the intensification, <br />change of use, or development shall conform with the following <br />applicable standards: <br />(a) Establishment of adequate setback lines to keep structures <br />separated from the Willamette River to protect, maintain, preserve, <br />and enhance the natural, scenic, historic, and recreational qualities <br />of the Willamette Greenway. Setback lines need not apply to water <br />related or water dependent activities as defined in the Oregon <br />Statewide Planning Goals and Guidelines (OAR 660-15-000 et seq.). <br />The subject property does not have an established Willamette Greenway setback line. As <br />illustrated on Sheets L01 Regulatory Plan (Exhibit A), the Applicant proposes the establishment of <br />a Willamette Greenway setback line to keep structures separated from the river and to protect, <br />maintain, preserve, and enhance the natural, scenic, historic, and recreational qualities of the <br />Willamette Greenway. The proposed setback line is coterminous with the 100-foot conservation <br />area setback from the top of bank of the Willamette River as established by the /WR Conservation <br />Overlay Zone. <br />Section C.3 of Goal 15 sets out use management considerations and requirements for local plans <br />and implementing measures. Subsection (k) provides for the Greenway setback. Other relevant <br />considerations include providing adequate public access to the river, protection of significant fish <br />and wildlife habitat, and enhancing and protecting the natural vegetative fringe along the River. <br />Through establishment of the setback line, this criterion is satisfied. <br /> (b) Protection of significant fish and wildlife habitats as identified in the <br />Metropolitan Plan Natural Assets and Constraints Working Paper. <br />Sites subsequently determined to be significant by the Oregon <br />Cameron McCarthy INITIAL SUBMITTAL | February 21, 2018 79 <br /> <br />
