The intersection of Capital and Cupola <br />Drive is well over 100 feet apart. The northern most and southern most intersections of Capital <br />Drive and Cupola Drive are well over 500 feet from each other. <br />EC 9.6835 Public Accessways <br />(1) The city shall require within the development site the dedication to the public and improvement <br />of accessways for pedestrians and bicyclist use to connect the development site to adjacent <br />cul-de-sacs or to an adjacent site that is undeveloped, publicly owned, or developed with an <br />accessway that connects to the subject site, provided the city makes findings to demonstrate <br />consistency with constitutional requirements. <br />None of these conditions exist on this site. Therefore, there is no need for public dedication of <br />accessways for pedestrian and bicyclist use. <br />EC 9.6840 Reserve Strips. <br />The city manager may require the developer to dedicate a reserve strip controlling the access to a <br />street or alley when a reserve strip is necessary to address one or more of the following: <br />(1) To prevent access to abutting land at the end of the street in order to assure the proper <br />extension of the street pattern and the orderly development of land lying beyond the street. <br />This condition does not exist. <br />(2) To prevent access to the side of a street on the side where additional width is required to meet <br />right-of-way standards provided in Table 9.6870 Right-of-Way and Paving Widths. <br />This condition does not exist. <br />(3) To prevent access to land abutting a street of the development, but not within the development <br />itself. <br />There may or may not need to be a reserve strip dedicated at the terminus of Capital Drive. <br />One was not found when researching the records, but that doesn't mean it doesn't exist. <br />(4) To prevent access to land unsuitable for development. <br />This condition does not exist. <br />(5) To prevent access prior to payment of street improvement assessments or connection <br />charges. <br />No known street improvement assessment or connection charges will be required as a result of <br />this development. <br />(6) To prevent access to an arterial or collector street when such access would be inconsistent <br />with EC 7.420. <br />Capital Drive is a local street. <br />EC 9.6845 Special Safety Requirements. <br />Except for applications proposing needed housing, where necessary to insure safety, reduce traffic <br />hazards and promote the welfare of the general public, pedestrians, bicyclists and residents of the <br />subject area, the planning director or public works director may require that local streets and alleys <br />be designed to discourage their use by non-local motor vehicle traffic and encourage their use by <br />local motor vehicle traffic, pedestrians, bicyclists, and residents of the area. <br />Capital Drive is proposed to be improved in the existing right of way. Cupola Drive is a looped <br />street that connects to Capital Drive at 2 intersections. This development does not create, <br />encourage, or provide through traffic, as it abuts Hendricks Park to the north where there is no <br />street connection. No connections have been provided to the east for reasons discussed earlier. <br />When it comes to motor vehicle traffic, the Capital Hill PUD is essentially a dead-end. Local motor <br />vehicle traffic will be the primary users of these streets.
