Eugene Ordinance Exhibit J <br />[Lane County Ordinance Exhibit G] <br />Comprehensive plans and implementing measures shall manage the use and division of urbanizable <br />land to maintain its potential for planned urban development until appropriate public facilities and <br />services are available or planned. <br />This action includes adoption of a /CL Clear Lake overlay zone that is being applied to the employment <br />land being added to the UGB for planned large site industrial development. The /CL overlay zone <br />protects those sites by limiting land divisions and permissible uses and activities that interfere with <br />development of the sites for their intended uses. See EC 9.4150 through 9.4170 of proposed code <br />provisions at Exhibit E to the City's ordinance. See also "Addendum to UGB Expansion Analysis for <br />Employment Land" at Appendix D to these findings. Lane County is also adopting those provisions into <br />the Urban Transition Code that will be applied in the UGB expansion areas. <br />ORS 197.298 Priority of land to be included within urban growth boundary. <br />(1) In addition to any requirements established by rule addressing urbanization, land may not be <br />included within an urban growth boundary except under the following priorities: <br />(a) First priority is land that is designated urban reserve land under ORS 195.145, rule or <br />metropolitan service district action plan. <br />Lane County and the City of Eugene have not designated any urban reserve land. <br />(b) If land under paragraph (a) of this subsection is inadequate to accommodate the amount of <br />land needed, second priority is land adjacent to an urban growth boundary that is identified in <br />an acknowledged comprehensive plan as an exception area or nonresource land. Second <br />priority may include resource land that is completely surrounded by exception areas unless <br />such resource land is high-value farmland as described in ORS 215.710. <br />The City of Eugene conducted a substantial analysis of second priority land in its study area (all land in <br />the vicinity of the UGB that has a reasonable potential to satisfy the identified deficiency) to determine <br />its adequacy to accommodate the school site needed. The land included in Eugene's study area for the <br />school site is described in section V.a of the UGB Expansion Analysis for School Land at Appendix A to <br />these findings. The identification, analysis and substantive findings addressing the second priority land <br />are located in section V.d of that Analysis. <br />The City of Eugene conducted a substantial analysis of the second priority land in its study area (all land <br />in the vicinity of the UGB that has a reasonable potential to satisfy the identified deficiency) to <br />determine its adequacy to accommodate the amount of employment land needed. The land included in <br />Eugene's study area for employment is described in section IlLa of the UGB Expansion Analysis for <br />Employment Land at Appendix B to these findings. The identification, analysis and substantive findings <br />addressing the second priority land are located in section Ill.d of that Analysis. <br />The City of Eugene conducted a substantial analysis of the second priority land in its study area (all land <br />in the vicinity of the UGB that has a reasonable potential to satisfy the identified deficiency) to <br />determine its adequacy to accommodate the amount of park land needed. The land included in <br />Eugene's study area for the two community parks is described in the UGB Expansion Analysis for Park <br />Land at Appendix C to these findings in section V.a under both "Bethel/Danebo Community Park" and <br />"River Road/Santa Clara Community Park."
