Eugene Ordinance Exhibit J <br />[Lane County Ordinance Exhibit G] <br />PHS' June 22, 2015 memorandum concludes that there are no significant wildlife habitat areas in the <br />Santa Clara UGB expansion area. There is one area of significant wildlife habitat located in the Clear Lake <br />UGB expansion area. A Goal 5 Significant Wildlife Habitat map of the resource area in the Clear Lake <br />area has been provided to the City of Eugene but due to restrictions on data distribution from the <br />Oregon Biodiversity Information Center (ORBIC), and to protect the species and its habitat, neither the <br />habitat nor the species have been named herein. This area of habitat is already identified on Lane <br />County's acknowledged inventory of significant wildlife habitat for lands inside the Metro Plan and <br />outside the current urban growth boundary (see policy C.16 from Chapter III, section C of the Metro <br />Plan). Pursuant to 660-023-0110(5), Lane County has limited publication, display and availability of <br />location information. To the extent that state agencies require review of the County's adopted Goal 5 <br />map and protection measures for this site, the County will make the information available. <br />2. Adopt Protection Measures for Significant Resource Sites (660-023-0050) <br />With the expansion of the UGB into the area, the County will continue to apply the already- <br />acknowledged protection measures for this wildlife habitat site. This action simply transfers the site <br />from the County's rural Goal 5 inventory to the Goal 5 Water Resources Conservation Plan which applies <br />within the Eugene UGB. New land use designations and zoning will not conflict with those acknowledged <br />protection measures: this significant wildlife habitat site will continue to be located on publically owned <br />land and the County will to rely on the acknowledged level of protection for the site, which is to rely on <br />state and/or federal protections and to send notice of any development permit or land use application <br />to the Oregon Department of Fish and Wildlife. <br />Statewide Planning Goal 6 - Air, Water and Land <br />Resources Quality <br />Statewide Planning Goal 6 "To maintain and improve the quality of the air, <br />water and land resources of the state." <br />The State has not yet adopted specific requirements for complying with Statewide Planning Goal 6. The <br />City and County are in compliance with environmental standards and statutes, including the federal <br />Clean Water Act and Clean Air Act. The actions taken are consistent with the jurisdictions' future <br />compliance with those laws. New development will be required to comply with the City's stormwater <br />standards and, in some areas, the /WQ Water Quality overlay zone adopted by the City as a tool to <br />implement Statewide Planning Goal 6. The areas are subject to the regulations of the Lane Regional Air <br />Protection Agency and, upon annexation, the Eugene Toxics Right to Know board. <br />19 <br />May 2017 <br />
