Eugene Ordinance Exhibit J <br />[Lane County Ordinance Exhibit G] <br />2014 entitled "City of Eugene Local Wetland Inventory - Clear Lake Area UGB Expansion." For the Santa <br />Clara area, PHS's wetland information is set out in a memo to the City dated October 21, 2014.2 <br />The City hired a second consultant, Winterbrook, to conduct the second part of the Goal 5 process (ESEE <br />Decision Process). Winterbrook's work is set out in a report dated December 8, 2016 titled "Goal 5 ESEE <br />Analysis for Significant Wetlands and Riparian Corridors." <br />1. Conduct an Inventory Process to compile a list of significant resources in the UGB expansion <br />areas. <br />(A) OAR 660-023-0100(3)(a) - Conduct a LWI using the standards and procedures of OAR 141- <br />086-0110 through 141-086-0240 and adopt the LWI as part of the comprehensive plan or <br />as a land use regulation. <br />For the Santa Clara UGB expansion area, PHS conducted a study that is described and documented in its <br />October 21, 2014 memo. PHS found that, in the Santa Clara expansion area, there were no wetland <br />areas greater than .5 acre. Under the Division of State Lands ("DSL") rules in OAR 141-086, these wet <br />areas "must be represented as points on the appropriate parcel(s) and should be labeled as "P[otential] <br />W[etlands]" on the maps. No further characterization or assessment is required for probable wetlands <br />in the LWI." As required, these areas were mapped as "Potential Wetlands" on an LWI (Figure 2 in <br />Attachment Ato PHS's memo). That "Local Wetlands Inventory- Figure 2" is included in these findings <br />at Appendix F.3 <br />For the Clear Lake area, PHS prepared a LWI using the standards and procedures of OAR 141 (DSL rules) <br />as noted on page 4 of PHS' report. That LWI (an index and three maps) is also included in these findings <br />at Appendix F. PHS identified 17 wetlands in the Clear Lake Area. The Clear Lake Area Local Wetland <br />Inventory was submitted to Division of State Lands in 2014, who conducted an initial review and <br />generally concurred with the analysis, inventory and findings of significance.' <br />(B) OAR 660-023-0100(3)(b) - Determine which wetlands on the LWI are "significant <br />wetlands" by using the criteria adopted by DSL pursuant to ORS 197.279(3)(b) <br />For purposes of the Goal 5 inventory, local governments are required to apply specific criteria adopted <br />by DSL to those wetland sites included on the LWI. Those that meet the criteria are "significant <br />wetlands" and must be included on the area's Goal 5 inventory of wetlands (but are not necessarily <br />protected wetlands, as addressed, below). <br />PHS found that, based on their size and status as "Potential Wetlands" under DSL's rules, none of the <br />five wet areas in the Santa Clara expansion area are significant wetlands. To reflect its content, the subject line should state: "City of Eugene Local Wetland Inventory and Riparian <br />Corridors -Santa Clara Area UGB Expansion." <br />s In an email from Ed Moore (DLCD) to Carolyn Burke (City of Eugene) dated January 30, 2013, DLCD confirmed that <br />the City does not need to have Division of State Lands approval of the local wetlands inventory prior to or <br />concurrent with the adoption of the amendment to expand the urban growth boundary because DSL will not <br />formally approve the LWIs until after the new UGB has been established.
