Eugene Ordinance Exhibit E <br />[Lane County Ordinance Exhibit F-3] <br />• Section 9.4700 of the Eugene Code, 1971, is amended to provide as <br />follows: <br />9.4700 Purpose of /WP Waterside Protection Overlay Zone. The purpose of the /WP <br />Waterside Protection overlay zone is to protect water quality in designated <br />waterways, riparian areas, and adjacent wetlands by maintaining an undeveloped <br />setback area between these features and adjacent developed areas. Maintenance <br />of this setback area is also intended to protect wildlife habitat and prevent property <br />damage from storms and floods. The /WP overlay zone is intended to maintain or <br />enhance open space areas adjacent to water features. These open space areas <br />are important because they typically contain native vegetation; convey, store, or <br />improve the quality of urban stormwater runoff; provide habitat for wildlife and, <br />where appropriate, can provide legally obtained access for channel maintenance. <br />Uses and activities permitted in these areas are restricted in most cases to those <br />that are consistent with the purpose of this overlay zone. Where conflicting uses or <br />activities are proposed, site plan approval based on conformance with specified <br />natural resource special standards (EC 9.2530 Natural Resource Zone <br />Development Standards) is required to minimize adverse impacts. The provisions <br />of this overlay zone are intended to implement policies in the [^no+,~, nI <br />comprehensive plan and refinement plans that call for protection of riparian <br />vegetation, wetlands, waterways, wildlife habitat, and surface and ground water <br />quality. <br />• The lead in paragraph of subsection (1) of Section 9.4800 of the Eugene <br />Code, 1971, is amended to provide as follows: <br />9.4778 /WQ Water Quality Overlay Zone - NVQ Management Area. <br />(1) Except as provided in subsections (2), (3) or (4) the /WQ Management Area is <br />that area depicted on the city's adopted Water Quality Waterways Map, <br />including any amendments made to it. <br />• Section 9.4800 of the Eugene Code, 1971, is amended to provide as <br />follows: <br />9.4800 Purpose of /WB Wetland Buffer Overlay Zone. The purpose of the /WB overlay <br />zone is to maintain or improve water quality within protected wetland sites identified <br />in the West Eugene Wetlands Plan by maintaining an undeveloped setback area <br />between the wetland and developed areas. Secondary benefits of buffers and <br />setbacks include creating open space between the resource and adjacent uses, <br />helping to maintain or improve wildlife habitat values and wetland hydrology, <br />protecting the aesthetic value of the site and minimizing property damage from <br />floods. The /WB overlay zone is also intended to maintain or enhance open space <br />areas adjacent to wetlands identified for protection in the West Eugene Wetlands <br />Plan.
