CONTE - EXHIBIT B Attachment B <br />AM <br />Public Works <br />Engineering <br />Memorandum <br />Date: April 10, 2017 <br />To: Erik Berg-Johansen <br />From: Scott Gillespie, PE <br />Subject: PDT-13-1 Oakleigh Lane Remand <br />At the request of Planning staff, Public Works staff has reevaluated testimony and evidence submitted <br />during the 2015 remand process, and still believe Oakleigh Lane provides safe and adequate access to the <br />proposed development. Oakleigh Lane is classified as a local street. It is designated as a Local Access <br />Road (LAR) as defined by Oregon Revised Statute and Lane County. The roadway begins at River Road <br />and terminates approximately 1,000 feet to the east at tax lot 1704242405400 (135 Oakleigh Lane). <br />Oakleigh Lane was first identified as a public road in 1927 (Oakleigh Plat, Land County Surveyors <br />Records). The roadway was dedicated to the public on the original subdivision plat. The Roadway was <br />improved to an approximate continuous width of 20 feet and is constructed to Lane County LAR <br />standards. The roadway has no curbs, and photographic evidence and testimony shows intermittent <br />parking on gravel shoulders. The roadway does not segregate vehicular, bicycle and pedestrian traffic. <br />This roadway configuration is common within the City of Eugene as well as the urban transition areas <br />within the Urban Growth boundary <br />During the previous remand proceedings, the applicant's engineer submitted testimony that identifies <br />the trip impacts from the proposed development site. The applicant dedicated the appropriate width of <br />right of way along the frontage of the development site. This is consistent with City code and <br />constitutional findings were made to justify the additional right of way. The applicant also submitted an <br />irrevocable petition to facilitate urbanization of the roadway at a future date through the Local <br />Improvement District process. Oakleigh Lane is not located in the City of Eugene and is not improved to <br />current City of Eugene urban street standards. The remaining section of Oakleigh Lane is not required to <br />be improved to City of Eugene urban standards because it is a local rural road in Lane County jurisdiction <br />and not located within the City of Eugene. The roadway was dedicated and improved as a rural access <br />way to LAR standards. The roadway has existed and functioned in its currently capacity for the entirety <br />of its existence. There is no indication the roadway is substandard because it currently meets the rural <br />LAR standards of Lane County. <br />The applicant's engineer addresses the intermittent parking concerns raised by the appellants. <br />Intermittent parking is a common feature City wide and acts as a built in traffic calming feature on most <br />local urban roadways. The applicants engineer has provided testimony and analyses for roadway <br />operations and safety, including evidence and analyses demonstrating the roadway has adequate <br />capacity to serve existing and proposed development. The applicant examined the crash history of the <br />entire roadway and concluded there is no evidence that would indicate a safety issue. The applicant's <br />engineer also provided discussion and evidence supporting the roadways adequacy for basic ingress and <br />egress to the development site, for all modes of travel. The applicant's engineer indicated the lack of the <br />urban features should not be interpreted as being unsafe or inadequate. City staff concurs with the <br />applicant's engineer and finds the existing Oakleigh Lane to be adequate to serve the development site. <br />City ,J Euyenz - 99 E. Bi oackvay.
