• <br />EC 9.6505(3) Streets and Alleys and (4) Sidewalks. <br />EC 9.6505(3)(b) requires the developer to pave streets adjacent to the development site to the <br />width specified in EC 9.6870 Street Width with provision for drainage and construction of curbs <br />and gutters, sidewalks, street trees and street lights adjacent to the development site according <br />to the Design Standards and Guidelines for Eugene Streets, Sidewalks, Bikeways and Accessways. <br />and standards and specifications adopted pursuantto EC Chapter 7 and other adopted plans and <br />policies. <br />Public Works staff confirms that Oakleigh Lane is not improved to City standards because it lacks <br />curbs and gutters, storm drainage, sidewalks, and street trees. The street does have existing street <br />lights and the 19-foot wide pavement width provides safe passage for two-way traffic. As such, <br />Public Works staff indicates that it is appropriate to defer public improvements via an irrevocable . <br />petition, with the following condition of approval: <br />• The applicant shall submit an Irrevocable Petition for public improvements in Oakleigh <br />Lane to include paving, curbs and gutters, storm drainage, sidewalks, and street trees. <br />Irrevocable petitions enable the City to initiate a local improvement process and obligate the <br />property owners to pay their proportional share of the street construction costs in the future. The <br />City could construct the street when the majority of benefitting property owners agrees to pay for <br />the improvements. Based on the above findings and condition, the development, will comply with <br />the applicable street improvement standards. <br />EC 9.6505(5) Bicycle Paths and Accessways. <br />Public right-of-way dedication is being required along the north property line, overlapping an <br />existing worn path between the terminus of Oakleigh Lane and the easterly City parklands, to <br />enable a future bicycle and pedestrian access way. Refer to the previous findings and condition at <br />EC 9.8320(5), which are incorporated by reference.. <br />(c) EC 9.6706 Development in Flood Plains through EC 9.6709 Special Flood Hazard <br />Areas - Standards. <br />The subject property is within a Special Flood Hazard Area (SFHA), per the Federal Emergency <br />Management Agency's (FEMA) Flood Insurance Rate Map (FIRM) 41039C-1128-F, dated June 2, 1999. <br />The applicant's topographical survey prepared by Poage Engineering and Surveying, Inc. delineates the <br />SFHA boundaries and notes that the Base Flood Elevation (BFE) is 401.2 feet. <br />Development is allowed to occur within the SFHA, subject to review and approval for compliance <br />with applicable development standards during the building permit process. These standards <br />generally require structures to be located at least one foot above the BFE, among other <br />requirements.
