Capital Hill PUD Page 44 of 63 <br />Planned Unit Development Application - Tentative Stage Written Statement <br />(4) Exemptions to the Solar Lot Requirements. A proposed lot shall not be identified as a "solar lot" <br />but shall be counted as a lot that satisfies EC 9.2790(2) Solar Lot Requirements when the lot <br />satisfies (a)(b)(c) or (d) of this subsection. <br />(a) Slopes. The lot is sloped 20 percent or more in the direction greater than 45 degrees east or <br />west of true south. <br />The lots that slope 20 percent or more in a direction greater than 45 degrees east or west of <br />true south are as follows: <br />Lots 1, 2,6,7,8,9,10,11,12,13,14,15,16,17,18,19,20,29,30,3 1,and 32 are considered solar lots, <br />due to the slope exemption. <br />Lots 4, 5, 24, 28 and 33 are solar lots. <br />In summary, 26 of the 35 lots are solar lots (or 74%). Therefore, this criterion is met. <br />(10)The PUD complies with all of the following: <br />(a) EC 9.2000 through 9.3915 regarding lot dimensions and density requirements for the subject zone. <br />Within the NVR Water Resources Conservation Overlay Zone . . <br />The development site is not within the /WR zone. <br />The subject zone is R-1, beginning with EC 9.2700, Table 9.2750 Residential Zone Development <br />Standards. <br />Minimum Net Density. No minimum <br />Maximum Net Density: 5 units per acre per South Hills Study <br />EC 9.2751 Special Development Standards for Table 9.2750 <br />(1) Density <br />(b) For purposes of this section, "net density" is the number of dwelling units per acre of land <br />in actual residential use and reserved for the exclusive use of the residents in the <br />development, such as common open space or recreation facilities. <br />The entire site is reserved for the exclusive use of the residents in the development. The <br />total site (net) is 13.10 acres or 570,485 sf. <br />(c) For purposes for calculating net density: <br />1. The acreage of land considered part of the residential use shall exclude public and <br />private streets and alleys, public parks, and other public facilities. <br />2. In calculating the minimum net density required for a specific lot or development site, <br />the planning director shall round down to the previous whole number. <br />3. In calculating the maximum net density allowed for specific lot or development site, the <br />planning director shall round up to the next whole number only for: <br />a. A lot or development site that is 13, 500 square feet or more in area; <br />b. A lot or development site that is not abutting the boundary of, or directly across an <br />alley from land zoned R-1; and <br />c. Fractions of .75 or above. <br />4. At the request of the developer, the acreage described in 1. above, also may include <br />natural or historic resources.... . <br />Density is calculated by using the acreage for the entire development site and <br />excluding the area dedicated for public right-of-way. The total development site is <br />13.63 acres. The net acreage is 13.10 acres, excluding the proposed private drive. The <br />proposed unit count is 37 - 43 units making the net density 2.9 - 3.2 units per acre, <br />well within the maximum of 5 units per acre allowed in property zoned R-1 and located <br />in the South Hills Study area east of Friendly Street. <br />Lot Area Minimum: 4500 SF <br />All lots meet minimum lot area (see Site Plan for lot area) <br />Schirmer Satre Group 9 375 West 4'" Avenue, Suite 201, Eugene, OR 97401 .
