Attachment A
LAW OFFICE OF BILL KLOOS, PC
OREGON LAND USE LAW
January 20, 2015
Eugene City Council
125 E. 8th Avenue, 2"a Floor
Eugene, OR 97401
Re: Eugene Sand and Gravel UGB Expansion Proposal
Dear Mayor and City Councilors:
375 W. 4"' STREET, SUITE 204
EUGENE, OR 97401
TEL (541) 954-1260
FAX (541) 343-8702
E-MAIL BILLKLOOS@LANDUSEOREGON.COM
We submit this letter and the attached exhibits on behalf of Eugene Sand and Gravel Limited
Partnership ("ES&G") for inclusion in the record of the Envision Eugene project.
In a lengthy February 4, 2014 letter to city staff we suggested that the staff recommend including
in the UGB a large tract of largely reclaimed aggregate mining land located on the Willamette
River north of Beltline, west of Delta Highway, and south of the golf course. We will resubmit
that full letter for the record.
Our suggestion was to bring in about 150 acres of ES&G land. Of this about 35 acres of open,
dry, reclaimed mining area could be designated for some kind of urban development. This is the
land adjacent to the south and west of the county shops on Delta Hwy. The balance of the acres,
adjacent to the river, could be brought in and designated for park and open space uses.
Between this area and Beltline to the south there is another 33 acres of ES&G riverfront land
already in the UGB. The City is actively trying to buy this from ES&G for park use.,
If the 35 acres of reclaimed land were to come into the UGB, then ES&G would facilitate
transfer of all the rest of the property, including the UGB land to the south (about 150 acres) to
the city for park use. The City would then include the riverfront from Beltline all the way north
through the golf course.
As far as we know, this proposal has not gotten a close look from city staff. It should get a
careful look. We believe it has the following benefits for the city:
1. The 35 acres for urban development would help meet needs for residential,
commercial or industrial lands immediately, thus offsetting the need for adding that acreage out
at the UGB fringe.
2. The property is essentially infill, with utilities and facilities already available on the
35 developable acres.
3. The 150 or so acres of park land along the river that would come with this addition
would be a public benefit and resource that likely would not be matched in our lifetimes.
