The city must proceed in this manner until all the land need is satisfied. <br />3 (c) If the amount of suitable land in a particular priority category in section (2) exceeds the <br />4 amount necessary to satisfy the need deficiency, the city must choose which land in that <br />5 priority to include in the UGB by applying the criteria in section (6) of this rule. <br />6 (2) Priority of Land for inclusion in a UGB: <br />7 (a) First Priority - Urban reserve, exception land, and nonresource land: Lands in the study <br />8 area that meet the description in paragraphs (A) through (C) of this subsection are of equal <br />9 (first) priority: <br />10 (A) Land designated as an urban reserve under OAR chapter 660, division 21, in an <br />11 acknowledged comprehensive plan; <br />12 (B) Land that is subject to an acknowledged exception under ORS 197.732; and <br />13 (C) Land that is nonresource land. <br />14 (b) Second Priority - Marginal Land: land within the study area that is designated as <br />15 marginal land under ORS 197.247 (1991 Edition) in the acknowledged comprehensive plan. <br />16 (c) Third Priority - Farm or Forest land that is not predominantly high value farm land: land <br />17 within the study area that is designated for agriculture or forest uses in the acknowledged <br />18 comprehensive plan that is not predominantly high-value farmland, as defined in ORS <br />19 195.300, or that does not consist predominantly of prime or unique soils, as determined by <br />20 the United States Department of Agriculture Natural Resources Conservation Service In <br />21 selecting as much of the suitable land as necessary to satisfy the need, the city must use the <br />22 predominant capability classification system or the predominant cubic site class, as <br />23 appropriate for the acknowledged comprehensive plan designation, to select lower capability <br />24 or cubic site class lands first. <br />25 Concern/question: Should there be the same protection afforded to prime forest land? <br />26 The USDA defines prime forestland to be lands capable of producing 85 cubic feet per <br />27 acre per year of certain tree species. <br />28 (d) Fourth Priority - Agricultural land that is predominantly high value farmland: land <br />29 within the study area that is designated as agricultural land in an acknowledged <br />30 comprehensive plan and is predominantly high value farmland as defined in ORS <br />31 195.300(10). A city may not select land that is predominantly made up of prime or unique <br />32 farm soils, as defined by the United States Department of Agriculture Natural Resources <br />33 Conservation Service, unless there is an insufficient amount of other land to satisfy its land <br />34 need. <br />5 <br />
