Proposed New Rules to Implement ORS 197A <br />1 <br />2 <br />3 <br />4 <br />5 <br />(c) Land within <br />(A) An urban renewal district; <br />December 3-4, 2015 - LCDC Salem <br />Agenda Item 4, Attachment A <br />Public Draft 3 - November 23, 2015 <br />(B) An enterprise zone, rural enterprise zone, or urban enterprise zone, as defined in ORS <br />285C.050; or <br />(C) A strategic investment zone, as defined in ORS 285C.623. <br />6 (d) Sites served by state or regional infrastructure investments, such as the Strategic Reserve <br />7 Fund (ORS chapter 285B), Connect Oregon, Immediate Opportunity Fund, or grant or loan <br />8 programs administered by the Infrastructure Finance Authority. <br />9 (e) Sites that include working port access or Class A rail access (e.g., access to existing <br />10 sidings or loops). <br />11 (f) Sites that have been certified as a shovel ready site by the Oregon Business Development <br />12 Department, or has received designation as a Regionally Significant Industrial Area by the <br />13 Economic Recovery Review Council. <br />14 (g) Land that was previously designated as industrial under rules under this division and may <br />15 not be redesignated as provided in OAR 660-038-0180(6). <br />16 (h) Land that is designated for a particular land need under OAR 660-024-0065(10). <br />17 OAR 660-038-0160 <br />18 Establishment of Study Area to Evaluate Land for Inclusion in the UGB <br />19 Cities outside of Metro shall comply with this rule and OAR 660-038-0170 when determining <br />20 which lands to include within the UGB in response to a deficit of land to meet long-term needs <br />21 that has been determined under OAR 660-038-0080, OAR 660-038-0150, or both. <br />22 (1) The city shall determine which land to add to the UGB by evaluating alternative locations <br />23 within a "study area" established pursuant to this rule. To establish the study area, the city must <br />24 first identify a "preliminary study area" which shall not include land within a different UGB or <br />25 the corporate limits of a city within a different UGB.
