December 3-4, 2015 - LCDC Salem <br />Agenda Item 4, Attachment A <br />Proposed New Rules to Implement ORS 197A Public Draft 3 - November 23, 2015 <br />1 (c) For lands within the tsunami inundation zone, no reduction unless the city's existing <br />2 zoning classification of such areas prohibits or reduces allowed development, in which case, <br />3 the reduction shall be based upon the maximum density allowed by the city's existing zoning <br />4 classification. <br />5 (d) For lands designated for commercial use, contiguous lands of at least one acre with slope <br />6 greater than 25 percent, a 100 percent reduction. If a lot or parcel has areas with slopes <br />7 greater than 25 percent, the reduction applies only to those areas with slopes greater than 25 <br />8 percent. <br />9 (e) For lands designated for industrial use, contiguous lands of at least one acre with slope <br />10 greater than 10 percent, a 100 percent reduction. If a lot or parcel with slopes greater than 10 <br />11 percent has at least five contiguous acres with slopes less than 10 percent, the reduction does <br />12 not apply to those areas. <br />13 (f) For lands subject to restrictions in density or location of development in an acknowledged <br />14 comprehensive plan or zoning program developed pursuant to Statewide Planning Goal 5 or <br />15 6, a reduction to the levels required by the acknowledged zoning. <br />16 (g) For lands subject to development prohibitions, natural resource protections, or both in <br />17 acknowledged comprehensive plan provisions that implement Statewide Planning Goals 16, <br />18 17, or 18, a reduction to the levels required by the applicable comprehensive plan provisions <br />19 and implementing land use regulations. <br />20 (3) The amount of buildable land in the UGB designated for commercial and industrial uses is <br />21 that amount determined in OAR 660-038-0120 reduced by the constraints determined under <br />22 section (2) of this rule. <br />23 OAR 660-038-0140 <br />24 Translate Job Forecast to Employment Land Need <br />25 OPTION to consider redevelopment (if the commission does not adopt this option, subsequent <br />26 rules in this division, and references to those rules, would be renumbered accordingly) <br />27 (1) Account for redevelopment of commercial land anticipated during the planning period, as <br />28 follows: <br />29 (a) Multiply the number of new commercial jobs forecast for the planning period to be <br />30 accommodated on employment lands in the UGB in either OAR 660-038-0100(7) or OAR <br />31 660-038-0110(5) by the applicable percentages in paragraphs (A) through (C) of this <br />32 subsection: <br />11/23/2015 3:43:00 PM <br />http://intranet.dlcd.state.or.us/projects/UGBRAC/Reference Documents/660-038_3rdPublicDraft_2015-11-20.docx v2.0 <br />18 <br />
