These referral <br />comments include draft findings and recommended conditions of approval, as well as related <br />informational items, relevant to surveying, engineering, transportation, and maintenance <br />issues identified by Public Works staff in the context of the applicable standards and criteria. <br />These referral comments are intended for review by Planning staff, for incorporation into the <br />City's written decision on the subject application, however, they do not represent a final <br />determination of compliance with the applicable approval standards and criteria. It is <br />acknowledged these referral comments are subject to revision upon further coordination with <br />other affected City departments and utility providers. <br />Summary: The applicant requests Conditional Use application approval to construct a <br />controlled income and rent housing development. Public Works staff does not find there is <br />sufficient information to recommend approval of the Conditional Use Permit based on the <br />following evaluation of the criteria specific to our area of expertise, per the Eugene Code in <br />effect at the time of application. <br />EC 9.724(2) Conditional Use Permit Approval Criteria - CIR/CUP <br />(a) Public facilities and services are available to the site. if the public services and facilities <br />are not currently available, an affirmative finding may be made if the evidence indicates that <br />they will be available prior to need by reason of: <br />1. Prior commitment of public funds or planning by the appropriate agencies, or <br />2. A commitment by the applicant to provide private services and facilities acceptable to <br />the appropriate public agencies, or <br />3.
