plans delineate these conservation areas. Uses within the resource area are subject to EC <br />9.4930 /WR Water Resources Conservation Overlay Zone - Permitted and Prohibited Uses and <br />Exceptions. The applicant's plans show the following uses within the resource area: <br />West Waterway <br />Public improvements (street, wastewater, stormwater, and other utilities) within the existing <br />West Amazon Drive right-of-way, which involves a perpendicular crossing of the stream <br />(between Senger Lane and Stonewood Lane) and a parallel impact within the resource area <br />adjacent to the stream (at the northwest corner of the site). Public improvements <br />(underground utilities) are also shown as crossing the water resource boundary in the same <br />location as the parallel impact for the roadway. <br />Middle Waterwa <br />Public improvements (street, wastewater, stormwater, and other utilities) within the existing <br />West Amazon Drive right-of-way and the extension of Canyon Drive; the intersection of these <br />two streets encompasses the entire resource area at that location. Public improvements <br />(underground utilities) are also show as crossing the resource boundary between the termini of <br />Morningwood Drive and Eveningwood Drive. <br />East Waterway <br />Public improvements (underground utilities) within the resource area and crossing the <br />waterway. <br />These public improvements require Standards Review approval pursuant to EC 9.4930(3)(b). <br />The applicant has not applied for Standards Review approval, but the written statement <br />indicates that the applicant will seek Standards Review approval at a later date. The applicant <br />has not submitted any evidence to demonstrate the feasibility of complying with the applicable <br />EC 9.4980 /WR Water Resources Conservation Overlay Zone Development Standards (1) <br />through (11), which are required for Standards Review approval. <br />Because the applicant will need to adjust the locations of roads (and thus possibly crossings <br />within the resource area, the hearings official cannot conclude that the PUD complies with this <br />criterion. The hearings official does not believe the applicant would be unable to show <br />compliance with Standards Review; the hearings official only notes that the current record does <br />not support a finding of compliance. <br />EC 9.8325(12): For any PUD located within or partially within the boundaries of the South <br />Hills Study, the following additional approval criteria apply: <br />(a) No development shall occur on land above an elevation of 900 feet except that one <br />dwelling may be built on any lot in existence as of August 1, 2001. <br />The subject property is below 900 feet in elevation. <br />Hearing Official Decision (PDT 10-2, CU 11-1) 32 <br />
