14. The final site plans shall note that the keystone block wall on Lots 4 and 7 and at the end of <br />Nelson Street within Tract A shall be located outside of the /WR conservation setback and that <br />all uses and development west of the block wall, including tree removal, is subject to <br />compliance with the applicable /WR overlay provisions begiunmig at EC 9.4900. <br />15. The final site plans, and all site development and building permit applications for Lots 4 and 7 <br />and development adjacent to those lots shall include protective fencing at the boundary the <br />/WR conservation area. The location of protective fencing shall be inspected and approved by <br />the city prior to beginning any construction related activities. All protective tree fencing shall <br />remain in place until the completion of all construction activities, unless relocation or removal <br />is otherwise approved under the direction of a certified arborist, with approval by the city. <br />16. Prior to final PUD-approval, the applicant shall submit a report from a certified arborist <br />documenting the information on the site plans provided for all trees, including their relative <br />location. If non-native trees are to be removed from the conservation area, those trees must be <br />replaced with native trees within six months of removal. <br />17. The final site plans shall note that Tract A is a non-buildable open space conservation lot and <br />that future uses subject to standards review may be,peimitted with standards review approval <br />and PUD modification approval, or otherwise may be allowed if permitted outright pursuant to <br />the /WR provisions beginning at EC 9.4900. <br />18. The CC&Rs recorded with the subdivision shall be consistent with the final PUD site plans <br />and shall refer to the,approved final site plans on file with the City of Eugene Planning <br />Division. The specific construction practices and applicable requirements to be noted on the <br />final site plans and in the CC&Rs will be further addressed at the time of the final PUD and <br />tentative subdivision. <br />19. The final site plans shall note that the south front yards of Lots 1-4 (along Nelson Street) are <br />subject to 5-foot yard setbacks rather than 10 foot setbacks established at EC Table 9.2750 and <br />that no intrusions are permitted within the modified front yard setback. <br />For information on items above, contact Shawna Adams.
