PDF Page 91 <br />Basins 3-5 (located in the middle and eastern portions of the site) will not be <br />permitted to exceed the existing capacity of the existing downstream piped and <br />ditch systems. For these basins, the proposal defers determination of capacity <br />to the design phase. The report notes that, if at the time of final design, it is <br />determined that there is inadequate capacity for the additional flows in any of <br />the downstream systems, detention systems providing for flow control similar <br />to that which is proposed for Basins 1 and 2 will be required. <br />The report does not indicate what potential impact or'site design changes may <br />result, should detention systems be necessary in Basins 3-5. The applicant's <br />stormwater plan Sheet 6.0 does show the.location of detention facilities in <br />Basins 1 and 2. With this information it can be determined if the facilities are <br />public or private and how they may impact site design. For example, it is noted <br />that the private detention facility in the northwest corner of the site is located in <br />an area that is shown on Sheet 3.0 is within a proposed forest conservation area. <br />These impacts and inconsistencies appear to require further information and <br />plan revisions that are not addressed in the application. Further, without any <br />information aboutthe design and.location of detention facilities that may be <br />required for Basins 3-5, deferral of this issue could have significant impact on <br />other elements of the project design, including areas of disturbance (grading, <br />tree removal, etc.) and perhaps building or street locations: Staff believes that in <br />order to adequately address this criterion, the applicant must determine now <br />whether in fact, there is adequate capacity and if not, show how detention <br />facilities will impact the site. Without such information, compliance with the <br />applicable standards remains in question. <br />Public Works referral comments in the file provide further information regarding <br />the stormwater standards at EC 9.6791 through 9.6797. Based on these findings <br />and available evidence, this criterion is not met. <br />In response, the applicant notes the following: <br />® City of Eugene Public Works Referral Response dated 8/7 (and revised 8/12, 8/13 <br />and 8/16) concludes the PUD application meets this criteria. <br />PUD Staff Report indicates additional information is needed regarding possible <br />stormwater detention system locations to document whether the detention <br />systems (if necessary) will be constructed in natural resource or preservation <br />areas. <br />Technical Memorandum by Branch Engineering, dated 8/27/2013 (Hearing Exhibit <br />13) clarifies that if stormwater detention is determined to be necessary during <br />final design, sealed detention systems such as vaults, tanks, or constructed <br />planters will be used, and they will be located in non-preservation areas such as <br />streets, parking areas, or other areas approved to be impacted. <br />The applicant is agreeable to a condition of approval requiring anyfuture <br />stormwater detention system not depicted in the PUD application shall be located <br />LaurelRidge Applicant Final Argument - Page 57 <br />140 <br />Laurel Ridge Record (Z 15-5) Page 895 <br />
