PDF Page 85 <br />Engineer's (ITE) publication Trip Generation. <br />The TIA application is discussed in the next section of these findings. <br />9.8320(6., The PUD will not be a significant risk to public health and safety, including <br />but not limited to soil erosion, slope failure, stormwater or flood hazard, or an <br />impediment to emergency response. <br />The proposed PUD will not pose a significant risk to public health and safety if the applicant <br />complies with conditions of approval regarding development set out elsewhere in this <br />evaluation. Those specific design and construction standards will be addressed through <br />subsequent subdivision applications and related permitting processes. This specifically includes <br />findings and requirements related to the applicant's stormwater drainage system and analysis, <br />and the applicant's geotechnical analysis. The subject property is not located within a <br />designated flood hazard area and erosion prevention permits will be required for various <br />components of the proposed development to ensure there are no significant risks associated <br />with soil erosion. <br />Emergency response will be facilitated by the available secondary access. See Applicant's Pre- <br />Hearing submittal, Exhibits 5, 5-1 and 5-2. <br />Additional Stormwater analysis clarifies that adequate downstream capacity exists for basins 3, <br />4 and 5. (See applicant's Hearing submittal, Exhibit 13). <br />Based on the evidence presented, and provided the applicant complies with the development <br />standards identified in the Geotech Report and subsequent requirements listed during permit <br />review, the HO can conclude that the proposed PUD will comply with this criterion. <br />9.8320(7). Adequate public facilities and services are available to the site, or if public <br />services and facilities are not presently available, the applicant demonstrates that <br />the services and facilities will be available prior to need. Demonstration of future <br />availability requires evidence.of at least one of the following: <br />(a) Prior written commitment of public funds by the appropriate public agencies. <br />(b) Prior acceptance by the appropriate public agency of a written commitment by <br />the applicant or other party to provide private services and facilities. <br />(c) A written commitment by the applicant or other party to provide for offsetting <br />all added public costs or early commitment of public funds made necessary by <br />development, submitted on a form acceptable to the city manager. <br />The Staff Report, at page 45-46, supports the conclusion that services are available or can be <br />provided, as explained in the annexation decision.
