But, for a property which may have more than one <br />plan designation or be adjacent to a plan designation boundary, where that designation or designation <br />boundary falls on the property is now in a different location than with prior Metro Plan diagrams. <br />The second concern is the validity of the north arrow rotation. We can't find anything in the legislative <br />record regarding the 2004 Metro Plan amendment which discusses the rotation of the north arrow. If <br />rotating the north arrow was not an intentional decision, with a methodology, justification and findings <br />supporting such, it can only be viewed as an error in the construction of the diagram. Causing further <br />concern that it may be just that - a scrivener's error - is that on the currently available Metro Plan <br />diagram, dated 12/31/2010, the one available at the above-referenced websites, the north arrow appears <br />to have been rotated back to its previous orientation, thus matching the 1980 and 1987 diagrams. <br />So where does that leave us. <br />We revised the application drawing ZC-4 - Zone Change: Metro Plan Diagram on Subject Property <br />(previously submitted Exhibit G). Because we were no longer confident in the pedigree of the digital <br />version of the 2004 diagram, we used our copy of the official adopted 2004 Metro Plan Diagram, the copy <br />we received as part of our July 2014 public records request. We scanned it, in color, at the highest <br />resolution we could. Now as a PDF, we imported it into the AutoCAD file containing the subject <br />property's boundary survey and 301h Avenue centerline. <br />At that point, we created two revised versions of sheet ZC-4. In one, we rotated the diagram 2 degrees <br />counter-clockwise to account for the rotation of the north arrow. We confirmed that the subject property's <br />boundary survey was still correctly oriented north. Taking special care to keep both diagrams oriented in <br />the same direction (doing so digitally, not by hand), and using the 30th Avenue centerline (as before), we <br />aligned the subject property over the Metro Plan diagram. We identified the boundary between the Parks <br />and Open Space (POS) designation and the Low Density Residential (LDR) designation. This sheet is <br />labeled ZC-4: Adopted 2004 Metro Plan Map Rotated. (See Exhibit L.) <br />Because we are not certain as to the intent behind the north arrow rotation on the 2004 diagram, we <br />produced a second ZC-4 sheet. Using the exact same methodology as with the first revised ZC-4, we <br />produced this second ZC-4 without rotating the Metro Plan diagram. This sheet is labeled ZC-4: Adopted <br />2004 Metro Plan Map Not Rotated. (See Exhibit M.) <br />Thus, we submit to the Hearings Official two interpretations of plan designation boundaries on the subject <br />property. The applicant believes that the correct interpretation is the second interpretation, the one where <br />the Metro Plan diagram has not been rotated. However, should the Hearings Official determine that the <br />Metro Plan diagram should be rotated, we present the first interpretation, the one where the Metro Plan <br />diagram has been rotated. As recommended by staff, to assist the Hearings Official, we also include a <br />legal description of the plan designation boundary for each of the two interpretations (see Exhibits O and <br />P). <br />In advance, thank you for your consideration of this material. <br />Sincerely, <br />IZ CchcWCL M.
