Request to Submit Testimony re PDT 13-1 <br />and Precautionary Objections <br />August 2.5; 2015. <br />Eugene Planning Commission <br />C/o Gabe Flock, Planner <br />City of Eugene <br />99 West 10th Avenue,. <br />Eugene, OR 9.7401. <br />Submitted by: Bryn Thoms <br />135 Oakleigh Lane <br />Eugene, OR 97404 <br />Re: City File No. PDT 134, Oakleigh PUD <br />Testimony for re-opened record <br />Dear Commissioners: <br />I am requesting to be allowed to submit testimony, including evidence and argument, into the record for <br />the above mentioned case. <br />On August 17, 2015, the Eugene Planning Commission (EPC) voted to re=open the record. However, the <br />EPC limited who could submit testimony to the applicant, Simon Trautman, and their respective <br />representatives. <br />ORS 197.763(7) requires: <br />When a local governing body, planning commission, hearings body or hearings officer reopens a <br />record to admit new evidence; arguments or testimony, any person may raise new issues which <br />relate to the new evidence, arguments, testimony or criteria for decision-making which apply to <br />the matter at issue, (Emphasis added.) <br />Allowing the applicant and Mr. Trautman to submit additional evidence and argument without also <br />allowing me and other participants in this matter to submit testimony would be unfair and prejudice my <br />substantial rights. <br />As a precautionary measure, 1. am objecting to the EPC rejecting my forthcoming testimony, including new <br />evidence submitted by August 31, 201:5 and arguments submitted by the deadline set by the EPC. <br />Sincerely, <br />Bryn Thorns <br />25 <br />
