3 <br />days after the filing of the Notice of Intent to Appeal, and outside the <br />21-day deadline established by ORS 197.763(7)(a). <br />2. LUBA correctly affirmed the City's transportation and health and <br />safety findings under Eugene Code sections 9.8320(5) and (6), where <br />traffic from the PUD would not result in adverse traffic or health and <br />safety impacts. <br />3. LUBA correctly affirmed the City's half-street dedication where the <br />same was necessary to address future transportation needs, but the <br />existing street and right-of-way was determined to be adequate to <br />continue to meet current local needs with the PUD. <br />8. Statement of Material Facts. <br />Intervenor-Respondent accepts Intervenors-Petitioners' statement of <br />facts. Pursuant to ORAP 5.55(2), Intervenor-Respondent offers the following <br />relevant facts: <br />On April 19, 2013, OMC filed its application for a Tentative Planned <br />Unit Development (PUD 13-01) for "co-housing development." LUBA Rec. <br />1502. As explained in the application materials: <br />"Cohousing combines the autonomy of private, single-family <br />dwelling with the advantages of community and multiple-family <br />living. Neighborhood design encourages sharing of skills and <br />resources and reduces environmental impacts through efficient <br />resource implementation and economical use of building space." <br />LUBA Rec. 1361. <br />
