Based on these findings, the following condiiion is <br />warranted: <br />The applicant shall submit an Irrevocable Petition for public improvements in <br />Oakleigh Lane to include paving, curbs and gutters, storm drainage, sidewalks, and <br />street trees. <br />Irrevocable petitions enable the City to initiate a local improvement process and obligate the <br />property owners to pay their proportional share of the street construction costs in the future. The <br />City could construct the street when the majority of benefitting property owners agrees to pay for <br />the improvements. , <br />5) Bicycle Paths and Accessways <br />No bicycle paths or public access ways are required per the previous findings at EC 9.6835, <br />which are incorporated by reference. <br />WHO The PUD complies with Special Flood Hazard Area development standards (EC 9.6705 <br />through EC 9.6709) <br />A significant portion of the site is within the Special Flood Hazard Area (SFHA) Zone AE as <br />identified on the Flood Insurance Rate Map 41039C and Panel 1128F. Staff disagrees with the <br />floodplain boundary as depicted on the proposed plan, i.e., Sheet 2; however the differences <br />are relatively insignificant. Buildings 1, 2, 4, the northernmost bike shed and the bike barn in <br />their entirety and portions of buildings 3 and 7 and the garage / carport structure are located <br />within the SFHA. It has been noted that the bike barn has not been elevated. The upstream <br />most Base Flood Elevation. shall be used for the entire development site unless each structure <br />has a separately determined BFE which is conf irmed by City staff. <br />Development is allowed to occur within the SFHA, subject to review and approval for <br />compliance with applicable development standards during the building permit process. All <br />development within the SFHA is required to comply with the standards at EC 9.6707 through EC <br />9.6709. These standards generally require, for areas located in Zone.AE, that structures be <br />located at I east one foot above the BFE among other requirements. At the time of development <br />(i.e. building permits), these standards may be addressed through several alternatives, <br />including elevated building foundations or, typically, placing fill on the building site. Specific <br />measures for compliance with SFHA standards will be subject to further City review and <br />approval at the time of building permits. <br />In order to ensure compliance with this standard the following condition is warranted: <br />• Prior to final PUD approval, the applicant shall submit for City review and -approval, <br />two paper copies of the final PUD plan, (i.e., Sheet 2), which includes the SFHA <br />PDT13-01 Oakleigh Cohousing <br />Page 15 of 22 <br />1269 <br />
