This criterion does not apply because the area of request is not within the boundaries of the <br />Willakenzie Area Plan. <br />EC 9.881515): In areas not covered by subsection (4) of this section, the intensification, <br />change of use, or development shall conform with the following applicable standards: <br />(a) " Establishment of adequate setback lines to keep structures separated from the <br />Willamette River to protect, maintain, preserve, and enhance the natural, scenic, <br />historic, and recreational qualities of the Willamette "Greenway. Setback lines <br />need not apply to water related or water dependent activities as defined in the <br />Oregon Statewide Planning Goals and Guidelines (OAR 660-15-000 et seq.). <br />Outside the Willakenzie Area Refinement Plan (WA_ P) and the Goal 5 Water Resource (/WR) <br />riparian conservation area (neither of which" affect the subject property), there is no regulatory <br />setback from the Willamette River. For context, the WAP, establishes a 35-foot setback and the <br />/WR establishes a 100-foot setback from the top of the bank of the Willamette River. In this <br />location, the /WR conservation area exceeds 100 feet from the riverbank, yet is still more than 50 <br />feet from the subject property (see Attachment A). <br />The existing setback, of more than 200 feet from the ordinary high water line of the.-Willa mette <br />River, -afforded by the intervening public park, is adequate to protect and maintain the natural. and <br />scenic qualities of the Willamette Greenway. The development plan preserves the natural and <br />scenic qualities of the site by maintaining the existing open prairie conditions along the eastern <br />portion of the site, by setting the buildings back from the east property line by at least 20 feet and <br />by creating common open space that will be vegetated with native grasses. <br />(b) Protection of significantfish and wildlife habitats as identified in the <br />Metropolitan Plan Natural Assets and Constraints Working Payer. Sites <br />subsequently determined to be significant by the Oregon Department of Fish and <br />Wildlife shall also be protected. <br />The Metropolitan Plan Natural Assets and Constraints Working Paper does not identify any <br />significant fish and wildlife sites on the subject property. Although the Willamette River Corridor is <br />an Anadromous Fish River that is designated as an essential Salmon Habitat by the Oregon <br />Department of Fish and Wildlife (ODFW), the subject property is located more than 200 feet west <br />of the ordinary high water line. No habitat protection measures appear to be required of the <br />proposed"development. <br />(c) Protection and enhancement of the natural vegetative fringe"along the <br />Willamette River to the maximum extent practicable. <br />The proposal does not affect the vegetated fringe along the Willamette River, which is located <br />more than 200feet to the east. The regulated riparian resource conservation area is shown on <br />Attachment A.
