delineates a more confined direction of travel, rather than random wandering through the City's <br />resource area. <br />This portion of the City property has been cultivated as a filbert orchard, which has been maintained <br />by the former owner of the subject property, as discussed in the applicant's written statement. There <br />appears to be an informal path between the orchard and the subject property that would direct <br />travelers to the southerly McClure Lane right-of-way. Public Works staff confirms that the planned <br />bicycle and pedestrian connection through the City's parkland is from McClure.Lane toward the <br />easterly West Bank Bike Path, which is a regional facility that borders the west bank of the Willamette <br />River. <br />Based on the above findings, and the condition at EC 9.8320(5), public access will be provided to the <br />river by appropriate legal means. Refer to Attachment B and C for visual representations of these <br />findings. <br />EC 9.8815(3): The intensification, change of use, or development will conform with <br />applicable Willamette Greenway policies as set forth in the Metro Plan. <br />Pages I11-D-4 and 5 of the Metro Plan contain the Willamette Greenway policies. Of these, several <br />policies provide direction to local governments regarding legislative decision-making and other <br />long range planning efforts, and do not constitute mandatbry approval criteria for the application. <br />The following Metro Plan policy is potentially relevant to the proposed development, and is <br />therefore addressed below. <br />Policy D.5: New development that locates along river corridors and waterways shall be <br />limited to uses that are compatible with the natural, scenic, and environmental qualities of <br />those water features. <br />The proposed use is appropriate in this location, as the Metro Plan designates the subject property <br />for residential uses. The proposed development is an allowed use that requires PUD approval; <br />staff has determined previously in this report that the proposed development is consistent with <br />the PUD approval criteria. To the extent the above policy is applicable, the development is setback <br />more than 200 feet from the river, with City parkland and riparian areas located between the <br />subject property and the river which will not be impacted by the proposed development. Further, <br />the development proposes open space along the eastern portion of the site, abutting the <br />parkland, and has setback buildings by at least 20 feet from the east property line. As such, the <br />proposed residential use is compatible with the natural, scenic, and environmental qualities of the <br />river corridor. <br />Based on the above findings, the proposed development is consistent with the applicable <br />Willamette Greenway policies set out in the Metro Plan.
