• "Flow from the site is reduced to pre development flow and is dispersed <br />using rip rap." <br />• "Treatment of the stormwater from the site conforms to the treatment <br />options listed in the 2008 Eugene Stormwater Manual and consists of <br />pervious pavements, 15 rain gardens, and a vegetated swale. Pervious <br />pavement will be located in the parking stalls, the entry and the fire <br />turnaround. Site walking surfaces and the roof tops of the homes will <br />utilize the 15 rain gardens around the site. Each rain garden is sized to <br />treat and reduce flows to predevelopment rates." <br />• "Sizing of the rain garden was performed by using the City of Eugene's <br />'Stormwater Surface Filtration/Infiltration Facility Sizing Spreadsheet[']." <br />"The car garage, drive strip, and Common House buildings will be treated <br />by the vegetated swale. A berm at the end of the swale will act as a weir to <br />reduce flows to predevelopment rates. The swale was sized using the <br />presumptive method." <br />The letter concludes with: "Calculations supporting the above are enclosed." <br />Any statement above that is not based on evidence already in the record or that <br />relies on data in the letter's attachments is impermissible. <br />4. OMC_PDT 13-1-Access Engineering Letter2.pdf <br />This letter contains the following statement of fact: <br />"However, there are properties that have dedicated additional right-of-way: <br />tax lot 640 I has dedicated additional right-of-way to 25 feet south of the <br />centerline and tax lots 4400 and 4500 have dedicated right-of-way to 30 feet <br />north of the centerline. This is a common occurrence throughout the River <br />Road area where former County roads have been annexed into the City." <br />There is no citation to the record, and unless evidence of the dedications that are <br />presented is already in the record, as well as evidence of "common occurrence,"the statement is impermissible new evidence. <br />This letter also contains the following statement of fact: <br />"The Ninth Edition of the Institute of Transportation Engineers Trip <br />Generation Manual on page 393 of Volume 2 states that 'the number of <br />dwelling units was generally used as the independent variable of choice <br />because it is usually readily available, easy to project, and had a high <br />correlation with average weekday vehicle trip ends.'" <br />October 16, 2013 Conte objection to impermissible new evidence re PUD 13-1 3 1 Page <br />446 <br />
