The City did not adopt a condition of <br />3 approval that would ensure the 45-foot right-of-way adjacent to the <br />4 proposed development's access point that the City's findings required. <br />5 It is indisputable that the City's adopted findings for EC 9.8320(5)(a) state that <br />6 Oakleigh Lane would be unsafe unless the right-of-way were widened to 45 <br />7 feet for at least fifty feet adjacent to the proposed PUD site. These findings are <br />8 clearly and forcefully presented in the Eugene PWD referral comments of <br />9 September 17, 2013. Rec 1255 to 1276. Rec 9, 16, 41-42, 44. <br />11 Based on the projected increase in traffic, the configuration and <br />12 condition of Oakleigh Lane and the number of additional structures and <br />13 residents that would be accessible only at the end of a 1,000-foot cul-de-sac, <br />14 the PWD analysis concluded that: <br />15 "It is in the public's interest to have Oakleigh Lane consist of 45 feet of <br />16 right-of way through the development site's entry drive aisle and to consist <br />17 of 33 feet beyond the drive aisle to the terminus of the street in order to <br />18 ensure: safety for pedestrians, bicyclists and motorists traveling on Oakleigh <br />19 Lane (a low-volume street); the efficient provision of emergency services; <br />20 and that the proposed development and adjacent properties are accessible <br />21 via Oakleigh Lane."3 (Rec 1256-1257) <br />3 PWD comments at Rec 1256-1258.
