The City did not adopt a condition of approval <br />4 that would ensure the 45-foot right-of-way adjacent to the proposed <br />5 development's access point that the City's findings required. <br />6 Subassignment of Error I.B. Decision did not properly apply street standards <br />7 to Oakleigh Lane, as required by EC 9.8320(5)(a), 9.6820(4) and 9.6870. <br />8 Subassignment of Error I.C. Decision did not properly evaluate the <br />9 requirements of EC 9.8320(5)(b) for pedestrian and bicycle circulation to <br />10 adjacent and nearby residential areas, transit stops and neighborhood activity <br />11 centers, with respect to Oakleigh Lane. <br />12 Subassignment of Error I.D. Decision failed to require a Traffic Impact <br />13 Analysis as required by EC 9.8320(5)(c) and EC 9.8670. <br />14 Subassignment of Error I.E. Decision failed to adequately evaluate whether <br />15 the PUD would be significant risk to public safety as required by EC 9.8320(6). <br />16 Subassignment of Error I.F. The Decision did not properly evaluate the <br />17 requirements of EC 9.8320(11)(b) for Oakleigh Lane improvements. <br />18 SECOND ASSIGNMENT OF ERROR <br />19 Decision erred in finding that the proposed PUD would have minimal off-site <br />20 impacts, as required by EC 9.8320(12). <br />
