-1, Low-Density Residential Zone implements, and is consistent <br />with, the low-density residential land use designation for the subject property in the Metro <br />Plan. The subject property is zoned R-1, and the proposed PUD is therefore subject to the <br />applicable R-1 zoning provisions as discussed throughout the following approval criteria and <br />related standards. To the extent that the PUD is found to be consistent with those applicable <br />zoning provisions and the PUD approval criteria, as is the case here, it is also consistent with the <br />more general policies of the Metro Plan and the approval criterion here at EC 9.8320(1). <br /> <br /> <br /> <br />Opponents argue that the applicant should have addressed two Metro Plan policies concerned <br />with allocation of residential densities - A.12 and A.13. PT-4. Generally, many neighbors <br />argued that the proposed co-housing is too dense compared to the existing individual single <br />family homes on Oakleigh Lane. PT-2, PT-9. <br /> <br /> Hearings Official Conclusions <br /> <br />The findings of the staff report are sufficient to show compliance with EC 9.8320(1) and the <br />Hearings Official adopts them by this reference. The opponents assert that policies A.12 and <br />A.13 apply, but do not effectively explain why that must be the case. The Hearings Official is <br />unconvinced that Metro Plan policies A.12 and A.13 apply. The subject property is zoned Low <br />Density Residential which is the same zone that the majority of the neighborhood is zoned. No <br /> <br />residential density which is the focus of policy A.13. Even if the two policies do apply, the <br />proposal is consistent with them because the density proposed is within the range allowed by <br />1 <br />the Low Density Residential zoning designation. <br /> <br />EC 9.8320(2): The PUD is consistent with applicable adopted refinement plan policies. <br /> <br /> Staff Findings <br /> <br />The River Road / Santa Clara Urban Facilities Plan (RR/SC UFP) serves as the applicable adopted <br />refinement plan for the area included in this tentative PUD proposal. The property is designated <br />Low-Density Residential on the Land Use Diagram in the refinement plan. Based on the prior <br />findings at EC 9.8320(1), which are incorporated here by reference, the proposed development <br />complies with the applicable plan designation as implemented through the R-1 zone.
