Attachment B <br />(d) EC 9.6710 Geological and Geotechnical Analysis. <br />Staff found, and the Hearings Official agrees that the geotechnical analyses requirements beginning <br />at EC 9.6710 apply because the proposed development is a PUD that has slopes in excess of five <br />percent. The applicant submitted a geotechnical analysis prepared by Foundation Engineering, Inc. <br />Public Works staff confirms that the applicant's analysis meets the Level Three Analysis requirements <br />of EC 9.6710(4)(c) and Administrative Order AO-58-02-25-F. The analysis includes the results of sub- <br />surface investigation and testing, to establish soil types and distribution, and the characteristics of <br />the site and soils, in relation to the proposed development. The analysis includes design <br />recommendations for construction and inspection. <br />Public Works staff confirms that the analysis confirms the suitability of the site for the proposed <br />development and notes that the geotechnical recommendations are industry standards. <br />Nevertheless, to ensure compliance as proposed, the following condition of approval is necessary: <br />• The final PUD site plans shall note that construction permits shall conform to the <br />applicant's geotechnical analysis. <br />Based on the above findings and condition, the geotechnical standards at EC 9.6710 will be met. <br />(e) EC 9.6730 Pedestrian Circulation On-Site. <br />Staff found and the Hearings Official agrees, that the development meets these standards by <br />providing pedestrian connections between the dwelling units and common facilities. The findings <br />for EC 9.8320(5)(b) are also incorporated here by this reference. <br />(f) EC 9.6735 Public Access Required. <br />Staff found, and the Hearings Official agrees, that the development will have access onto a <br />public street, Oakleigh Lane, consistent with this standard. Referral comments from Public <br />Works staff confirm that the other requirements of this standard are also met. <br />(g) EC 9.6750 Special Setback Standards. <br />Staff found, and the Hearings Official agrees, that the applicant's plans show a 20-foot special <br />setback from the north property line for future right-of-way for Oakleigh Lane. Public Works <br />staff confirms that a special setback is not needed, based on the right-of-way needs being <br />exacted as a condition of development. The required dedication to provide needed right of <br />way obviates the need for a special setback along the northern property line.
