plans, and a description of design and height is included on Sheet A-2. <br />The general capacity of the tower in terms of the number and type of antennas <br />it is designed to accommodate. <br />The capacity of the tower and number of antennas it is designed to accommodate is included in <br />Exhibit P of the applicant's materials. <br />Documentation demonstrating compliance with non-ionizing electromagnetic <br />radiation (NIER) emissions standards asset forth by the Federal <br />Communications Commission (FCC). <br />The applicant provided a report as Exhibit 0, which includes the documentation demonstrating <br />compliance with non-ionizing electromagnetic radiation (NIER) emission standards as set forth by the <br />Federal Communications Commission (FCC). This report was subsequently reviewed by Environalysis <br />LLC on behalf of the City of Eugene as required at EC 9.5750(11). The review concluded that "The <br />information in the applicant's proposal is sufficient to determine that the noise and NIER impacts of <br />the project fall well within regulatory limits set by Federal and local jurisdictions. No special conditions <br />need to be applied to mitigate noise or NIER emissions." _ <br />4. A signed agreement, as supplied by the city, stating that the applicant will allow <br />collocation with other users, provided all safety, structural, and technological <br />requirements are met. This agreement shall also state that any future owners <br />or operators will allow collocation on the tower. <br />A signed agreement has been provided by AT&T that will allow collocation with other users, provided <br />all safety, structural and technological requirements are met. This agreement is included as Exhibit Q <br />of the applicant's materials. <br />5. Documentation that the ancillary facilities will not produce sound levels in <br />excess of those standards specified in subsection (7) of this section, or designs <br />showing how the sound is to be effectively muffled and reduced pursuant to <br />those standards. <br />The applicant originally submitted an Acoustical Report with the PUD application then provided an <br />updated Acoustical Report (Exhibit R) which includes documentation demonstrating compliance with <br />the standard. It confirms that noise generating equipment shall be sound-buffered by means of <br />baffling, barriers, or other suitable means to reduce sound level measured at the property line to <br />45dBa, as required. This report was subsequently reviewed by Environalysis LLC on behalf of the City <br />of Eugene. The review concluded that no special conditions need to be applied to mitigate noise. <br />Response to testimony asserting that the decibel level should include existing noise is included below <br />in subsection (c)(7). <br />6.
