Environalysis LLC on behalf of the City of Eugene as required at EC 9.5750(11). The review <br />concluded that "The information in the applicant's proposal is sufficient to determine that the <br />noise and VIER impacts of the project fall well within regulatory limits set by Federal and local <br />jurisdictions. No special conditions need to be applied to mitigate noise or NIER emissions." <br />Given that the proposal meets these requirements, there is no evidence there will be <br />substantial off-site impact from NIER emissions. <br />Visual Impacts -The findings and conditions provided in the concurrent PUD (PDT 10-2) at EC <br />9.8320(3), (12) and (13) are incorporated here by reference. <br />Based on the findings above, this criterion is met. <br />(c) If the proposal involves a residential use, the project is designed, sited and/or <br />adequately buffered to minimize off-site impacts which could adversely affect <br />the future residents of the subject property. <br />The proposed use is not residential; this criterion is not applicable. <br />EC 9.8090(3): The location, design, and related features of the proposal provides a <br />convenient and functional living, working, shopping or civic environment, and is as <br />attractive as the nature of the use and its location and setting warrant. <br />This criterion relates the nature of the use. In this case, the use is a telecommunications tower <br />and ancillary facilities. It does not provide a living, working, shopping or civic environment. The <br />findings and conditions provided in the concurrent PUD (PDT 10-2) at EC 9.8320(3), (12) and <br />(13) are incorporated here by reference. <br />EC 9.8090(4): The proposal demonstrates adequate and safe circulation exists for the <br />following: <br />(a) Vehicular access to and from the proposed site, and on-site circulation and <br />emergency response. <br />Vehicular access is provided from Cal Young Road on a private driveway to the site. The findings <br />at EC 9.8320(6),(7) and (11)(f) are incorporated herein by reference to show compliance with <br />this criterion. Based on these incorporated findings, adequate and safe vehicular access to and <br />from the site, on-site circulation, and emergency response will be provided as a result of the <br />proposed development. <br />(b) Pedestrian, bicycle and transit circulation, including related facilities, as <br />needed among buildings and related uses on the development site, as well as <br />to adjacent and nearby residential areas, transit stops, neighborhood activity <br />centers, office parks, and industrial parks, provided the City makes findings to <br />demonstrate consistency with constitutional requirements.
