as specified in paragraph (c) below, for applications requiring a site <br />review or conditional use process: <br />1. A description of the proposed tower location, design and height. <br />The applicant provided a description of the proposed tower location on Sheets T-1 and G-1 of <br />the site plans, and a description of design and height is included on Sheet A-2. <br />The general capacity of the tower in terms of the number and <br />type of antennas it is designed to accommodate. <br />The capacity of the tower and number of antennas it is designed to accommodate is included in <br />Exhibit P of the application materials. <br />3. Documentation demonstrating compliance with non-ionizing <br />electromagnetic radiation (NIER) emissions standards as set <br />forth by the Federal Communications Commission (FCC). <br />The applicant provided a report as Exhibit O of the application materials, which includes the <br />documentation demonstrating compliance with non-ionizing electromagnetic radiation (NIER) <br />emission standards as set forth by the Federal Communications Commission (FCC). This report <br />was subsequently reviewed by Environalysis LLC on behalf of the City of Eugene as required at <br />EC 9.5750(11). The review concluded that "The information in the applicant's proposal is <br />sufficient to determine that the noise and NIER impacts of the project fall well within regulatory <br />limits set by Federal and local jurisdictions. No special conditions need to be applied to mitigate <br />noise or NIER emissions." <br />4. A signed agreement, as supplied by the city, stating that the <br />applicant will allow collocation with other users, provided all <br />safety, structural, and technological requirements are met. This <br />agreement shall also state that any future owners or operators <br />will allow collocation on the tower. <br />A signed agreement has been provided by AT&T that will allow collocation with other users, <br />provided all safety, structural and technological requirements are met. This agreement is <br />included as Exhibit Q of the application materials. <br />5. Documentation that the ancillary facilities will not produce <br />sound levels in excess of those standards specified in subsection <br />(7) of this section, or designs showing how the sound is to be <br />effectively muffled and reduced pursuant to those standards. <br />The applicant originally submitted an Acoustical Report with the PUD application then provided <br />an updated Acoustical Report (Exhibit R). Together, these reports opine that the proposed <br />Hearing Official Decision (PDT 10-2, CU 11-1) 27 <br />
