Attachment A <br />EC 9.8090(8): The proposal complies with all applicable standards, including but <br />not limited to: <br />Many of the standards referenced under this criterion appear to be inapplicable, but the <br />written statement should respond to each to confirm applicability. For access, confirm the <br />frequency of vehicle access to the equipment area. For stormwater, identify any <br />added/replaced impervious surfaces. <br />(a) EC 9.2000 through 9.3915 regarding lot dimensions, solar standards, and <br />density requirements for the subject zone; <br />RESPONSE: EC 9.2000 through 9.3915 lay out zoning requirements for Base Zones and Special <br />Zones. The code requirements applicable to the proposed project are the Residential Zone Land <br />Use and Permit Requirements of EC 9.2740. The proposed project conforms to these <br />requirements, as described in the Statement of Compliance submitted to the City of Eugene with <br />this application on April 30, 2014. See Att. 03 (Written Statement of Compliance). <br />The Solar Standards of EC 9.2780, et seq. apply to the creation of lots within subdivisions. The <br />proposed project would not create a lot, thus the Solar Standards do not apply. The density <br />requirements in the Special Area Zone Sections of EC 9.3000, et seq. do not apply to the <br />proposed project because the project is not within any Special Zone. <br />Specifically: <br />Table 9.2750 Residential Zone Development Standards <br />The subject property is zoned R-1. Minimum density per acre: no minimum. Maximum <br />density per Acre: 14 units. This proposal does not add any residential units therefor density <br />is not applicable. <br />Table 9.2760 Residential Zone Lot Standards. <br />The cell tower is not required to be placed on its own separate tax lot. No new lots are being <br />created therefore the lot standards do not apply. <br />EC 9.2790 Solar Lot Standards <br />Solar lot standards apply to the creation of lots within subdivisions in R-1 and R-2 zones. This <br />application is not a proposal for a subdivision, therefore the solar lot standards do not apply. <br />EC 9.2795 Solar Setback Standards <br />These standards apply to all structures on R-1 and R-2 zoned lots, 4000 sf or greater, with a <br />minimum north south dimension of 75 feet. The structure is not over 4000 sf and is not 75 <br />feet long in the north south direction therefor this criterion does not apply. <br />(b) EC 9.6500 through EC 9.6505 Public Improvement Standards; <br />RESPONSE: The Public Improvements Standards do not apply because the proposed project is <br />Completeness Review: New Cingular Wireless - Crossfire Church (CU 14-3) 13 <br />
