Acknowledged and agreed. (4) Standards for Triplexes and Fourplexes. Triplexes and fourplexes shall comply with all of the following: (a) Garages and Off-Street Parking Areas. Garages and off-street parking areas shall not be located between a building and a public street, except in compliance with the standards in subsection 1 or 2 below. The existing garage is not between the building and the public street. If it were it would be considered existing non-conforming. At the time of building permit the development will be reviewed for compliance with this criterion. 2. The combined width of all garages and outdoor on-site parking and maneuvering area does not exceed a total of 50% of the street frontage. No development is proposed. This will be evaluated at time of building permit submittal for compliance with this criterion. (b) Driveways. 1. In lieu of access connection standards in EC 7.410, triplexes and fourplexes shall comply with subparagraphs 2 – 5 of this subsection. Triplexes and fourplexes shall comply with the access connection standards in EC 7.420 through 7.445. 2. The total width of all driveway approaches must not exceed 32 feet per frontage, as measured at the property line (see Figure 9.5550(4)(b)2-3. Triplex/Fourplex Driveway Approach Width and Separation on Local Street). For lots or parcels with more than one frontage, see subsection 5. The lot has frontage on one street. The existing access is 14.98 feet wide measured at the property line. Proposed driveways will be evaluated at time for building permit for compliance with this criterion. 3. Driveway approaches may be separated when located on a local street if they comply with the access connection spacing standards in EC 7.420 (see Figure 9.5550(4)(b)2-3. Triplex/Fourplex Driveway Approach Width and Separation on Local Street). Gilham Road is not a local street. It is classified as a Minor Arterial. Proposed driveways will be evaluated at time for building permit for compliance with this criterion. 4. For lots or parcels abutting an alley that meets the paving width standards of EC 9.6870, access must be taken from the alley. Not applicable. No existing alleys. EC 7.420 Access Connections – Location. (1) Access Connections to all Street Classifications. Access connections to all street classifications shall be located in accordance with the following standards: (a) No access connection shall be located to encompass a municipal utility. 1521 Gilham Road 9 Middle Housing Land Division, Tentative Plan: Written Statement October 30, 2026 Schirmer Consulting, LLC · PO Box 10424, Eugene, OR 97440 · (541) 234-5108 Landscape Architecture + Land Use Planning The access connection, when proposed during building permit, will not encompass a municipal utility. (b) Except when an existing lot or parcel frontage is located entirely within an area where the adjacent street grade is over fifteen percent (15%), no access connection shall be located in areas where the street grade is over fifteen percent (15%). Not applicable. Existing street grade is not over 15%. (c) If a parcel has frontage on two or more streets of different street classifications, the access connection shall access the street with the lowest classification. The access connection can access the street with the higher classification if the applicant can demonstrate (1), (2) or (3): Not applicable. The parcel has street frontage on one street. (d) Access connections located within five feet of an existing alley connection may be merged with the alley pavement. Not applicable. No existing or proposed alleys. (2) Access Connections to Arterial and Major Collector Streets. In addition to the standards set forth in this EC 7.420(1), access connections to arterial and major collector streets shall be located in accordance with the following standards. (a) Except when an existing lot or parcel is located entirely within the intersection influence area, no access connection to an arterial or major collector street shall be located within the intersection influence area. If an existing lot or parcel is located entirely within the intersection influence area, an access connection, of minimum width, onto an arterial or major collector street will be permitted provided the access connection is located along the property line furthest from the intersection. 2. Influence areas of partially controlled intersections shall be based on the street classification as set out in the chart below. The influence area for the primary street shall be measured from the centerline of the secondary street, the influence area for the secondary street shall be measured from the centerline of the primary street. If the intersecting streets have the same street classification, both streets are considered primary streets. Gilham Road is a Minor Arterial road. The property is almost completely within the influence area of the partially controlled intersection at Galloway Court. The access to Middle Housing Lots (Parcels 2 and 3) will be located along the property line furthest from the intersection. (b) Access connections shall be spaced based on the street classification as set out in the chart below. The spacing area shall be measured from the 1521 Gilham Road 10 Middle Housing Land Division, Tentative Plan: Written Statement October 30, 2026 Schirmer Consulting, LLC · PO Box 10424, Eugene, OR 97440 · (541) 234-5108 Landscape Architecture + Land Use Planning edge of one access connection to the leading edge of another access connection. (d) Applicant with an existing lot or parcel as of April 10, 2010, that cannot meet the spacing requirement, does not qualify for a reduction in the spacing requirements, and has no other access to the lot or parcel, will be allowed one minimum-width restricted movement access connection. This is an existing parcel created prior to April 10, 2010. The potential access to the north for Middle Housing Lots (Parcels 2 and 3) will be located as far from the existing access as possible. It will not meet the spacing requirements and does not qualify for a reduction in the spacing requirements and there is no other access to the parcels. Any proposed access will be reviewed at time of building permit and should be allowed one minimum width restricted movement access connection. Note: The property has only 100 feet of street frontage. The existing driveway serves a garage that will remain, and the place where a potential proposed access may be located is 65 feet away (the greatest feasible separation). A shared driveway would require demolition of the existing garage. Removing a functional structure solely to achieve shared access is not a reasonable alternative. Placing the potential future access furthest away from the existing access puts it less than 150 feet from the existing access to the north. EC 7.420(2)(d) already recognizes the need to accommodate access to existing parcels where spacing requirements cannot be met and no other access is available. Although the proposed land division creates new lots, the underlying frontage constraint predates the division. Treating the new lot boundaries as a reason to require discretionary review elevates the date of lot creation over the physical conditions governing access. These physical constraints exist regardless of the proposed land division. Requiring an Adjustment Review cannot increase the frontage, move the existing garage, or produce a more compliant access arrangement. It instead adds application costs, delay, and exposure to appeal to a housing proposal that already provides the maximum feasible separation. (c) Entry Orientation and Windows. 1. Entry Orientation. a. At least one main entrance for each triplex or fourplex structure must meet the standards in subparagraphs b. or c. below. Any detached structure where more than 50 percent of its street-facing facade is separated from the street property line by a dwelling is exempt from meeting these standards. 1521 Gilham Road 11 Middle Housing Land Division, Tentative Plan: Written Statement October 30, 2026 Schirmer Consulting, LLC · PO Box 10424, Eugene, OR 97440 · (541) 234-5108 Landscape Architecture + Land Use Planning The existing structure meets this requirement with a front door facing the street. Proposal for development of these lots will comply with this standard and be evaluated for compliance at time of building permit submittal. 2. Windows. All street-facing facades, except those separated from the front lot line by a dwelling, shall have windows or entrance doors covering at least 15 percent of the applicable facade area. The existing structure is not required to meet this requirement. Proposal for development of these lots will comply with this standard and be evaluated for compliance at time of building permit submittal. (2) If the property to be divided is developed with middle housing: The property to be divided is not developed with middle housing. (3) The proposed middle housing land division complies with all of the following: (a) EC 9.2777, Middle Housing Lot standards; (1) There are no frontage, width, or lot area standards for middle housing lots. Acknowledged. (2) A middle housing lot may not contain more than one middle housing unit. A middle housing lot that includes a common area, but does not include a dwelling, is permitted. Each of the proposed lots will contain no more than one middle housing unit. (3) A middle housing lot may not be divided. Acknowledged. (b) EC 9.6505, Improvements, Specifications for any street frontage improvements required for middle housing lots that abut a street; EC 9.6505 Improvements - Specifications. All public improvements shall be designed and constructed in accordance with adopted plans and policies, the procedures specified in Chapter 7 of this code, and standards and specifications adopted pursuant to Chapter 7 of this code. Additionally, all developments shall make and be served by the following infrastructure improvements: (1) Water Supply. All developments shall be served by the water system of the Eugene Water & Electric Board. All lots will be served by EWEB. (2) Sewage. All developments shall be served by the wastewater sewage system of the city, complying with provisions in Chapter 6 of this code. Public improvements will be constructed privately. All proposed parcels will be served by the wastewater sewage system of the city of Eugene (municipal structure and wastewater treatment plant). They will be served by a public waste water line in Gilham Road. See Tentative Middle Housing Land Division plan for location. Electric While not specifically listed in the land use code this utility is being addressed. All lots will be served by EWEB electric. 1521 Gilham Road 12 Middle Housing Land Division, Tentative Plan: Written Statement October 30, 2026 Schirmer Consulting, LLC · PO Box 10424, Eugene, OR 97440 · (541) 234-5108 Landscape Architecture + Land Use Planning (3) Streets and Alleys. (a) The developer shall grade and pave all streets and alleys in the development site. All paving shall be to the width specified. . . . There are no streets and alleys proposed as part of this Middle Housing Land Division. (b) The developer shall pave streets and alleys adjacent to the development site to the width specified in EC 9.6870 Street Width, unless such streets and alleys are already paved to that width, provided the City makes findings to demonstrate consistency with constitutional requirements. All paving shall provide for drainage of all such streets and alleys, and construct curbs and gutters, sidewalks, street trees and street lights adjacent to the development site. Gilham Road is not designated on the Street Right-of-Way map and is considered a Minor Arterial street. Table 9.6870 indicates a Minor Arterial street has a right-of-way width of 65’ – 100’ and has a paving width of 46’ – 70’. The current right-of-way width is 60’ and the paving width is 40’. This street does not meet the right-of-way and paving standards set forth in Table 9.6870. (c) The standard at (3)(b) may be adjusted if consistent with the criteria of EC 9.8030(19). No request for adjustment is being made. (4) Sidewalks. Sidewalks shall be located, designed and constructed according to the provisions of this land use code, the Design Standards and Guidelines for Eugene Streets, Sidewalks, Bikeways and Accessways, construction and design standards adopted pursuant to Chapter 7 of this code, and other adopted plans and policies. There are sidewalks on both sides of Gilham Road. (5) Bicycle Paths and Accessways. Bicycle Paths and Accessways shall be designed and constructed according to provisions of this land use code, the Design Standards and Guidelines for Eugene Streets, Sidewalks, Bikeways and Accessways, construction and design standards adopted pursuant to Chapter 7 of this code, and other adopted plans and policies. No new bicycle paths or accessways are proposed because of this development. There are bike lanes on both sides of Gilham Road. (c) EC 9.6805, Dedication of Public Ways; and EC 9.6805 Dedication of Public Ways. As a condition of any development, the city may require dedication of public ways for bicycle and pedestrian use as well as for streets and alleys, providing the city makes findings to demonstrate consistency with constitutional requirements. This development site does not propose any new public ways. (d) All other applicable development standards for features explicitly included in the application. (4) The following easements are shown on the tentative plan: (a) Easements necessary for locating, accessing, replacing, and servicing all utilities; The following easements are either existing or proposed. · Proposed 20 Foot Wide Private Access and Pedestrian Access and Utility Easement. (b) Easements for pedestrian access from each dwelling unit to a street; The proposed 20 Foot Wide Private Access and Pedestrian Access and Utility Easement will provide pedestrian access for Middle Housing Lots (Parcels 2 and 3) to the ROW. Middle Housing Lot (Parcel 1) fronts the ROW. (c) Easements necessary for any common areas or shared building elements; Not applicable. (d) Easements necessary for any shared driveways or parking. The proposed 20 Foot Wide Private Access and Pedestrian Access and Utility Easement will accommodate any potential future shared driveway. (5) Separate utilities are provided for each dwelling unit. See Tentative Middle Housing Land Division plan for location of these utilities. (6) The middle housing land division results in one dwelling unit on each middle housing lot, except lots, parcels or tracts that include a common area. Lots, parcels or tracts that include a common area, but do not include a dwelling unit, are permitted. Each Middle Housing Lot will have only one unit. This can be evaluated at time of building permit submittal for compliance. (7) The application demonstrates that buildings or structures on the middle housing lots created by the middle housing land division will comply with applicable building code provisions related to new property lines; and, notwithstanding the creation of new lots or parcels, that structures or buildings located on the middle housing lots will comply with the Oregon Residential Specialty Code. The existing building meets required setback standards to the proposed property line. To the extent that any building does not meet setback requirements it is considered existing non- conforming. A referral from city of Eugene Building and Permit Services staff dated November 18, 2024, (for MHT 24-15 and referenced here) states that the proposed Middle Housing Land Division complies with the applicable provisions of the Oregon Residential Specialty Code. The ORSC grants municipalities the authority to implement jurisdictional Administrative Rules to be applied on a local level, in place of the congruent section of the ORSC. In this case, the applicable requirement is the City of Eugene's Administrative Rule R-8.005-(A)(3)(a) Existing Installation, which reads as follows: Buildings, structures, electrical and mechanical systems and equipment, and plumbing systems and fixtures constructed and maintained in conformity with the regulations in effect at the time of construction may have their existing use or occupancy continued, if such use or occupancy is in accordance with the original design and location and was legal at the time of the adoption of these regulations and provided such use is not hazardous to life, health or property and is not in conflict with statutes, rules, regulations, or ordinances of any federal or state agency or municipality. 1521 Gilham Road 14 Middle Housing Land Division, Tentative Plan: Written Statement October 30, 2026 Schirmer Consulting, LLC · PO Box 10424, Eugene, OR 97440 · (541) 234-5108 Landscape Architecture + Land Use Planning According to referral comments, City of Eugene Building and permit Services does “not require any type of City of Eugene inspection or private home inspection documents be provided to prove maintenance with codes in effect at the time occupancy was granted.” As such, the existing unit located on the subject property is considered part of an existing use which is “in accordance with the original design and location and was legal at the time of the adoption of these regulations.” Any unit proposed for the Middle Housing Lots will be reviewed for compliance with current building code at time of building permit submittal. (8) The following notes are included on the tentative plan: (a) The middle housing lots shown on the tentative plan were created pursuant to a middle housing land division and may not be further divided. See Tentative Middle Housing Land Division plan for this note. (b) The middle housing developed on the middle housing lots shown on the tentative plan shall remain middle housing and shall not be considered to be any other housing type as a result of the middle housing land division. (9) The proposed middle housing land division will not cause any existing improvements on the middle housing lots to be inconsistent with applicable standards in this land use code. The proposed middle housing land division will not cause any existing improvements on the middle housing lots to be inconsistent with applicable standards in this land use code. The proposed north and east property lines are more than 5’ from the existing building to remain.
