Location: 3425 Coburg Road Tax Lot: 17-03-09-34 Tax Lots 2900 & 3000 Current Zoning: R1 Size: 99,028 s.f. = 2.27 acres Plan Designation: R1 Electric: Electric: Electric: Electric: EWEB Water: Water: Water: Water: EWEB GasGasGasGas: : : : Northwest Natural Storm/SanitaryStorm/SanitaryStorm/SanitaryStorm/Sanitary: : : : City of Eugene APPLICATION REQUIREMENTS ORS 92.176(1) A county or city may approve an application to validate a unit of land created through a sale that did not comply with the applicable criteria for creating a unit of land if the unit of land: (a) Is not a lawfully established unit of land; and (b) Could have complied with the applicable criteria for the creation of a lawfully established unit of land in effect at the time the unit of land was sold. RESPONSE The subject tax lots were established in their current configuration through deeds recorded in 1977. Prior to that conveyance, the overall boundary of the subject property was established through deeds recorded in 1962 (Recording Nos. 1962-88217 and 1962-88218). Because the subject tax lots were created through deeds recorded after April 2, 1962, and the division did not comply with the applicable land division requirements, the tax lots do not qualify as lawfully established units of land. This application seeks to demonstrate that the subject property, considered as a whole, could have complied with the criteria in effect at the time of the 1962 conveyances and therefore qualifies for validation pursuant to ORS 92.176(1). Page 2 of 3 THE FAVREAU GROUP CIVIL ENGINEERING The attached deeds document the overall boundary of the subject property as established in 1962. Although the deeds describe the entirety of the property’s overall boundary, they do not describe the individual tax lots in their current configuration. Also attached is the Lane County Revised Subdivision Ordinance, dated April 2, 1962, which provides the applicable standards for evaluating the property. No permits are requested as part of this application under ORS 92.176(3). At the time the overall property boundary was established in 1962, the subject property could have complied with the applicable requirements of Section V, Platting Standards, subsection (D), Lots, paragraph (1), Size and Frontage, of the Lane County Revised Subdivision Ordinance, as discussed below. 1. Width The ordinance required a minimum lot width of 60 feet. The subject property has an average width of approximately 200 feet, substantially exceeding the minimum width requirement. 2. Depth The ordinance required a minimum lot depth of 80 feet, with a maximum depth of 2.5 times the average lot width. Based on the subject property's average width of approximately 200 feet, the maximum lot depth would be approximately 500 feet. The property's existing depth is approximately 700 feet and therefore exceeds the standard maximum depth. However, Section V(D)(1)(b), Exceptions, subsection (1), Subdivision Area Developed as a Unit, provided the Planning Commission with authority to grant exceptions to lot size and frontage requirements where the subdivider presented a plan demonstrating that the property would be further developed. Given that the subject property is currently the subject of a tentative subdivision application, a plan demonstrating the potential for further subdivision could have been presented to support a request for an exception to the maximum depth requirement. Accordingly, the property could have qualified for consideration of an exception under the ordinance in effect at the time. 3. Minimum Lot Area The ordinance required a minimum lot area of 6,000 square feet. The subject property contains approximately 124,210 square feet, substantially exceeding the minimum lot area requirement. 4. Frontage The subject property has approximately 185.25 feet of frontage on Coburg Road, substantially exceeding the ordinance's minimum frontage requirement. CONCLUSION The overall boundary of the subject property was established through deeds recorded in 1962 (Recording Nos. 1962-88217 and 1962-88218), and the property was subsequently reconfigured into its current tax lot configuration through deeds recorded in 1977. Page 3 of 3 THE FAVREAU GROUP CIVIL ENGINEERING As demonstrated above, the subject property, considered as a whole, could have complied with the applicable criteria for the creation of a lawfully established unit of land in effect at the time of the 1962 conveyances. Although the property's depth exceeded the ordinance's standard maximum, the ordinance provided a mechanism for the Planning Commission to consider exceptions under the circumstances described in Section V(D)(1)(b)(1). Based on the foregoing, the applicant respectfully requests that Lane County approve this application to validate the subject property as a lawfully established unit of land pursuant to ORS 92.176(1).
