Written Statement
Submitted Missing Incomplete N/A
☐ ☒ ☐ ☐
1. Detailed written statement that describes how the request is eligible for
the lot validation process under ORS 92.177and whether the lot
validation is being requested under lot validation criteria ORS 92.176(1)
or (2).
☐ ☒ ☐ ☐
2. Indicate how the subject property is not a lawfully established unit of
land. (e.g., documentation from County that property was created by
deed after April 2, 1962, and prior to January 1, 2007, or a City of Eugene
Legal Lot Verification letter indicating the lot is not legal under EC
9.0500).
☐ ☒ ☐ ☐ 3. Indicate whether a building permit or land use permit for the subject
property is also being requested under ORS 92.176(3).
☐ ☐ ☒ ☐ 4. Is the applicant using the correct version of the code and the most
updated version of the application form?
Comments:
1. Lot Validation Criteria: It does not appear that a written statement addressing the Lot Validation criteria was
included in the submitted application materials. Please submit a written statement that demonstrates how the
Lot Validation request complies with the criteria at ORS 92.176 (1) or (2).
2. Written Statement: Please submit a detailed written statement that thoroughly explains why the subject
property does not meet the Eugene Code definition (EC 9.0500) of a legal lot. It may be helpful to include
additional deeds that show what the configuration of the subject property was prior to it being established in its
current configuration (i.e., deeds that could help staff locate the underlying legal lot).
3. ORS 92.176(3): In addition to the items above, please confirm in your written statement whether a permit is
currently being requested under ORS 92.176(3).
4. Lane Code: Please see Completeness Review Item #16 below.
Site Plan Requirements
Submitted Missing Incomplete N/A
☐ ☐ ☒ ☐
5. A site plan, drawn to scale. A Tax Assessor's map may be used as a base
for a site plan, provided the site plan is drawn to scale. (It is
recommended that the site plan be prepared, stamped and signed by a
registered professional land surveyor. )
☐ ☐ ☒ ☐ 6. Date, north arrow, and standard engineer's scale shown on the plan.
☒ ☐ ☐ ☐ 7. Assessor's Map and Tax Lot numbers shown.
☒ ☐ ☐ ☐ 8. Dimensions and square footage of the area subject to the lot validation
process.
☒ ☐ ☐ ☐ 9. Property lines that are subject to the lot validation process shown and
clearly-labeled.
☒ ☐ ☐ ☐ 10. All adjacent streets, alleys, accessways, and driveways.
Lot Validation Completeness Review Form Page 2 of 2
☐ ☐ ☐ ☒ 11. Location of all existing structures, including those under pending
building permits, shown and drawn to scale.
☒ ☐ ☐ ☐
12. Width and locations of all existing public utility easements, and any
other areas restricting use of the parcels, such as conservation areas,
slope easements, access easements, etc., shown and labeled.
(Recommended)
Comments:
5. and 6. Scale: It appears that the numbers shown on the included scale may not align with the labeled lot
dimensions (e.g., the distance shown as 240 feet in the scale nearly aligns with the 300-foot dimension labeled
for the subject property’s northern boundary). Please ensure that the scale is accurate to the drawing.
Supporting Analysis and Documents
Submitted Missing Incomplete N/A
☒ ☐ ☐ ☐
13. The Tax Assessor’s map for the subject property highlighting the area
subject to the request (available at Lane County Assessment and
Taxation).
☒ ☐ ☐ ☐ 14. The property description card(s) for the property (available at Lane
County Assessment & Taxation).
☒ ☐ ☐ ☐
15. A copy of the deed being relied upon for the lot validation process of ORS
92.177 and 92.176 (deeds are available at the Lane County Deeds &
Records Office).
☐ ☐ ☒ ☐ 16. A list of applicable code sections describing lot size and dimension
standards in effect when the subject property was created.
☐ ☐ ☐ ☒
17. If the subject property is not annexed, and the request is for review
under validation criterion ORS 92.176(2), a list of County building permits
issued for the structure in question.
☐ ☐ ☒ ☒ 18. A preliminary title report submitted. (Recommended)
Comments:
16. Lot Standards: While the provided application materials include four pages of the Lane Code in effect as of July
21, 1972, these pages do not appear to include a comprehensive list of the lot standards in effect in Lane County
as of April 12, 1971. Based on the available information, it appears that the 1962 Lane County Revised Subdivision
Ordinance contained the lot standards that were in effect from April 2, 1962, until February 10, 1972. Please
submit a written statement that addresses the lot standards in said ordinance.
18. Preliminary Title Report: The legal description included in the provided preliminary title report (issued
December 2025) does not appear to describe Tax Lot 02900 in its current configuration. While an updated title
report is not necessary at this time, please note that an updated preliminary title report will likely be required at
the time of Lot Validation plat submittal.
