Plat signed by an Oregon licensed land surveyor. A list of plat requirements subject to City Survey staff review is
available at the City of Eugene Public Works offices, at 180 W. 8th Avenue, Suite 200, Eugene, OR 97401.
As required, include the following:
Delineation of the flood plain or floodway boundaries.
The community number, map/panel number and effective date of the relevant FIRM map.
A note including the Base Flood Elevation for each lot.
A stamped, dated narrative from the surveyor or engineer explaining the methodology used to determine
the Base Flood Elevation.
The applicant is responsible for submitting a copy of the plat signed by an Oregon licensed land surveyor to the Lane
Current title report issued by a title insurance company licensed by the State of Oregon, verifying ownership by the
applicant of the real property.
Draft Irrevocable Petition for Public Improvements, as required
Draft Bargain and Sale Deeds for reserve strips, as required.
Draft Conditions, Covenants, and Restrictions or Joint Access Easement and Maintenance Agreement, as required
Drywell certification signed by a civil engineer, based on field-observed soil types and percolation rates, as required.
Off-site easements and right-of-way, as required.
Alternate Methods and Materials (AMM) application, fire separation easement and receipt demonstrating the AMM
has been submitted to Building and Permit Services staff for review, as required.
Verification of the storm drainage maintenance agreements, as required

Background
This Tentative Partition Plan proposed a 3-parcel partition of the real property identified as Lane County Assessor’s
Map & Tax Lot 17-04-26-14-05300, also known as 299 and 303 Bethel Drive (“subject property”). The subject
property is It is located on the west side of Bethel Drive, perpendicular to Pershing Street. There are two existing
dwellings on the subject property; both will remain. The proposed partition will create three parcels, Parcel 1 (P1)
containing the existing dwelling with site address 303 Bethel Drive and Parcel 2 (P2) containing the existing dwelling
with site address 299 Bethel Drive. Parcel 3 (P3) will be vacant.
This written statement addresses the approval criteria for a final partition at EC 9.8240. The approval criteria for a
final partition are in italics and the responses are included in plain text.
Partition, Final Plat Approval
EC 9.8240 Partition, Final Plat Approval Criteria
(1) The city surveyor has approved the final plat for compliance with applicable platting
requirements in accordance with state law.
A draft copy of the final partition plat is included with this application for review by the city surveyor. Any comments
or corrections to the plat that are requested by the city surveyor will be addressed prior to recording of the final plat.
The final plat contains all required elements as required by applicable state platting requirements.
(2) Streets, bicycle paths, accessways, and alleys for public use have been dedicated without any
reservation or restriction other than reversionary rights upon vacation.
There are no required street, bicycle paths, accessways, or alley dedications. This criterion is not applicable.
(3) Public improvements as required by this land use code or as a condition of tentative plan
approval are completed, or:
(a) A performance bond or suitable substitute as agreed upon by the city and applicant has
been filed with the city finance officer in an amount sufficient to assure the completion
of all required public improvements; or
(b) A petition for public improvements and for the assessment of the real property for the
improvements has been signed by the property owner seeking the partition and the
petition has been accepted by the city engineer.
There are no proposed or required public improvements associated with this partition application; thus no
performance bond is necessary. This criterion is not applicable.
(4) Public assessments, liens, and fees with respect to the partition have been paid, or:
(a) A segregation of assessments and liens has been applied for and granted by the city, or
(b) An adequate guarantee in a form acceptable to the city manager has been provided
assuring the liens, assessments and fees will be paid prior to recording the final plat.
No public assessments, liens, or fees are known to exist with respect to the subject property. However, the property
owner will pay any assessments, liens, and/or fees if any are discovered.
(5) All conditions of tentative partition approval have been met and the final plat substantially
conforms to the provisions of the approved tentative partition.
The parcel layout on the final plat is consistent with the approved tentative partition plan. This means that the final
plat substantially conforms to the provisions of the approved tentative partition. In addition, the tentative partition
application was approved with two (2) conditions. Compliance with the conditions of approval is discussed below.

1. The applicant must provide a deed restriction that requires future residential development to
provide no less than five (5) residential units, or no less than six (6) residential units if the final
plat survey determines the development site to be at least 0.40 acres, and (if applicable)
consistent with maximum density of EC 9.2750, on Parcel 3.

2. An Irrevocable Petition shall be submitted with the final plat for public improvements to Bethel
Drive to include curb and gutter, and street trees.

Petitioner hereby irrevocably petitions the City of Eugene to initiate the following local improvements in accordance with th e standard
specifications of the City:
Curb and gutter, and street trees within Bethel Drive.
This petition is presented to the City so that Petitioners’ property may be developed and receive municipal services from the City which will
directly benefit Petitioners’ property and shall remain in full force and effect until the above described public improvements have been
constructed and accepted for maintenance as public improvements by the City Engineer. It is understood by Petitioners that:
1. The cost of the improvements shall be borne by the benefited property in accordance with state law, the Charter of the City of Eugene
and its ordinances and policies.
2. The City in its sole discretion may initiate the construction of all or part of the local improvements requested or may join all or part of
Petitioners’ property with other property when creating a local improvement assessment district.
3. Petitioners and Petitioners’ heirs, assigns and successors in interest in the property shall be bound by this irrevocable pet ition which
will run with the property and will be recorded by the City in the deed records of Lane County.
4. Petitioners declare that the public improvements herein sought will directly benefit the described property and will directly benefit the
City through improvements to the public way and public utilities serving the property and other properties in the vicinity.
5. Petitioners shall not challenge the formation of a local improvement assessment district by City and in any proceedings there in will
acknowledge this petition if requested to do so by City.
6. If the City is required to file an action in any court of competent jurisdiction to enforce the language in this petition or to prohibit the
violation of any of the covenants contained herein, the prevailing party shall be entitled to recover reasonable attorney fee s and costs
and disbursements of litigation at trial or on appeal.
