Response to Findings and Decision of the Planning Director
Nick:
Thank you for all your communication through this application process. The following are the responses to the Final
Plat Application Requirements, Conditions of Approval and Information Items. The City items are in regular typeface
and our responses are in italics.
EC 9.8198 Middle Housing Land Division, Final Plat – Approval Criteria.
The planning director shall approve or deny the final plat for the middle housing land division. Approval shall be based
on compliance with the following criteria, unless specifically exempt from compliance through a code provision
applicable to a special area zone or overlay zone:
(1) The city surveyor has approved the final plat for compliance with applicable platting requirements in accordance
with state law.
The final plat is being submitted with this application to obtain this approval.
(2) Streets, bicycle paths, accessways, and alleys for public use have been dedicated without reservation or
restriction other than revisionary rights upon vacation.
No dedications required on this Middle Housing Land Division.
(3) Public improvements as required by this land use code or as a condition of tentative plan approval are completed
or:
(b) A petition for public improvements and for the assessment of the real property for the improvements has been
signed by the property owner seeking the partition and the petition has been accepted by the city engineer.
No public improvements are required by this land use code or condition of approval.
(4) Public assessment, liens, and fees with respect to the middle housing land division have been paid, or:
(a) A segregation of assessments and liens have been applied for and granted by the city,
(b) An adequate guarantee in a form acceptable to the city manager has been provided assuring the liens,
assessments, and fees will be paid prior to recording the final plat.
There are no liens, assessments, or fees associated with the partition.
(5) All conditions of tentative middle housing land division approval have been met and the final plat substantially
conforms to the provisions of the approved tentative middle housing land division.
All conditions of tentative partition approval have been met. See responses below, revised Tentative Partition map
and Final Plat map.
Conditions of Approval
1. The applicant shall provide documentation from EWEB confirming that the proposed public utility easement meets
all applicable EWEB requirements to ensure access for water service.
See EWEB comments attached to the Tentative decision. When EWEB was asked directly what proof they could
provide they said their review of the land use application and their comments were proof. Other than that they
were uncertain what this meant.

2. The applicant shall provide documentation from EWEB confirming that the proposed public utility easement meets
all applicable EWEB requirements to ensure access for water service.
While this condition of approval says ‘water service’ it was found under the staff decision for ‘electric’ so am
assuming was intended to say ‘access for electric service’.
See EWEB comments attached to the Tentative decision. When EWEB was asked directly what proof they could
provide they said their review of the land use application and their comments were proof. Other than that they
were uncertain what this meant.
3. Prior to final plat approval, the applicant shall record a deed restriction holding Middle Housing Lots 1 and 2 in
common ownership until the existing building (shed) is removed or necessary easements are in place and it is in
compliance with the land use code and building code. The deed restriction shall include confirmation from the
Eugene Planning Director that the condition(s) for removing the deed restriction have been met prior to removal of
the deed restriction. Alternatively, prior to final plat approval, the applicant shall submit documentation that the
existing building (shed) is removed or necessary easements are in place and it is in compliance with the land use
code and building code.
See attached Deed Restriction.
4. Prior to final plat approval, the applicant will provide evidence that separate water and electrical service lines can
be provided to each Middle Housing Lots 1, 2, 3 and 4 within the bounds of each respective parcel.
The separate utilities are shown on the Tentative Plan complete with required easements.
Post Approval
Pursuant to EC 9.7920(4), the decision of the Planning Director is effective on the 15th day after notice of the decision
is mailed, unless appealed according to the procedures in EC 9.7640. The tentative Middle Housing Land Division
approval shall remain effective for 36 months following the effective date of approval, in accordance with EC 9.7230.
The applicant has requested review of this Middle Housing Land Division application subject to the amended
Expedited Land Division procedures of ORS 197.365, as amended by House Bill 2138. Pursuant to House Bill 2138,
the decision may only be appealed by the applicant. Appeals to Expedited Land Division determinations are subject to
the amended provisions of ORS 197.830 to 197.855, as amended by House Bill 2138. Appeals of Expedited Land
Division Decisions are subject to review by the Oregon Land Use Board of Appeals (LUBA). The decision of the
Planning Director Final on the local level. The Tentative Middle Housing Land Division Approval shall remain effective
for 36 months following the effective date of approval, in accordance with EC 9.7230.
A final site plan and performance agreement will be required for this Middle Housing Land Division in accordance with
EC 9.7025. EC 9.7925 states that, when the approval requires a final site plan, the applicant shall provide the city with
four copies of the plans that meet the conditions of approval of the Planning Director’s decision.
This approval does not relieve the applicant from complying with other applicable provisions of the Eugene Code,
Oregon Revised Statutes, or any other laws which may govern the development of the subject property

Informational Items
Final Plat Requirements
· A plat check fee will be required at the time of final plat application. These fees are subject to change; plat
check fees will be assessed according to the fee schedule in effect when the final plat application is
submitted.
A final plat check fee was paid with this submittal. As there is no fee schedule at this time no fee was
required.
· Lane County Surveyor’s Office is responsible for review of ORS 209. A separate copy of the final plat and
Lane County application fees must be submitted to Lane County Surveyor’s Office prior to the first plat review.

· A current title report must be submitted with the final plat. The final plat must show all easements,
encumbrances and restrictions listed in the title report, and all owners or interest holders must sign the
Declaration or submit concurrences.

· If any public utility easements are shown on the final plat, the following restriction will be required to be shown
on the final plat in accordance with EC 9.6500(3): “No building, structure, tree or other obstruction shall be
placed or located on or in a Public Utility Easement.”

· Taxes for the current year must be paid prior to recording of the final plat. The applicant should contact the
Lane County Surveyor’s office to make arrangements.

Eugene Building & Permit Services Informational Items
· If at the time of development the Eugene/Springfield Fire Marshal (or their designee) determines that there is
inadequate water supply, apparatus access, or both, to the site for the development of multi-unit dwellings
that will be subject to the Oregon Building Code, the Eugene Building Official (or their designee) may require
compliance with one or more of the fire suppression or fire containment Uniform Alternate Construction
Standards set out in OAR 918-480-0125(4) and (5).

Electric Comments
An electric service extension is required to serve the new middle housing lots. Extension of electric facilities will be
designed to meet City of Eugene Utility Permitting ordinances, land use ordinances, EWEB standards, and other
applicable codes. The cost of facility relocation and extension to these parcels will be borne by the requesting
customer and executed under EWEB policies and procedures at the time request for electric service is made. After
EWEB provides the customer with an electric design, typically the electric service conduit and conductors are installed
by customer to current codes and EWEB specifications and inspected by EWEB. There is an EWEB dedicated
easement on the northwest parcel (TL 902), so that can be used to provide electric service across parcels.
The applicant or their representative should initiate an updated estimate request with EWEB electric by contacting
Distribution Engineering at 541-685-7521 or DistributionEngineering@eweb.org, as the last estimate was in 2023.

Water Comments
There is an existing 8” water main on west side of Old Coburg Road. All new parcels will need separate water
services. Contact EWEB’s Building and Renovation Services department at (541) 685-7086 to arrange for the new
services.

EWEB Water Recommends the developer contact the Fire Marshall concerning fire protection requirements for
building permits.
EWEB Water does not allow installation of any water facilities under “rain gardens” or any open drainage structure
within the right of way. Provisions within the design must be made to accommodate the installation of water facilities
(services & hydrants) at common lot corners. A minimum 5 foot wide “utility corridor” at service crossing and hydrant
locations is required. State drinking water regulations (OAR 061-0050(10)) require a minimum separation between
water and sewer lines of 10’ where they run parallel to each other, unless the sewer line is located with 1.5’ of
clearance lower than the water line then the required separation is 5’.
EWEB owned water facilities will be located in the right-of-way, or in a minimum 7’ public utility easement (PUE)
adjacent to the public right-of-way.

Right-of-Way Comments
Easements must be either Public Utility Easements or EWEB Easements if they are to accommodate EWEB facilities.
A PUE or EWEB Easement is required for the existing overhead lines crossing Parcel 1 that serve proposed Parcel 2,
unless those lines are relocated prior to recordation of the final plat.
If a Public Utility Easement is designated on the plat, the plat should include the customary note for PUEs: “No
building, structure, trees, shrubbery or other obstruction shall be placed or located on or in a public utility easement.”
Because an EWEB Easement will be designated on the plat, a separate EWEB Easement document will need to be
created by EWEB Property Management. This document will be recorded with the Plat. In addition, if an EWEB
Easement is designated on the plat, EWEB requests that a Note be added to the plat stating: “EWEB easements shall
include EWEB and its joint users with whom it may contract. At no time shall any building, structure, sign or other
obstruction shall be erected or placed or located within an EWEB utility easement area without prior written consent of
EWEB.”
This note will be added to the Final Plat and a separate EWEB easement document will be submitted with this Final
Plat.

County Oregon Deeds and Records are parcels of land with the following restriction regarding
the use of these parcels for residential purposes:
Lot 1 and Lot 2 of this Middle Housing Land Division shall remain
under common ownership until the existing shed is removed.
