Statement
134 Etkay Drive, Eugene, Oregon 97404
I. Description of Proposal
A. Overview
The applicant is requesting annexation of the property located at 132/134 Elkay Drive, Eugene,
Oregon 97404, from unincorporated Lane County into the City of Eugene.
The property is located within the Eugene Urban Growth Boundary and is part of the River
Road —Santa Clara area. The proposed annexation is voluntary and is being pursued in
conjunction with the applicant's plans for future residential development of the property.
The applicant proposes to develop an approximately 1,800-square-foot duplex on the property.
The proposed duplex would provide two residential dwelling units intended for long-term rental
housing. The proposed development will provide additional housing on an existing residential
property while making efficient use of land and existing urban infrastructure.
Annexation will allow the property to be developed under the applicable City of Eugene land use
and development regulations and will place the property within the City's jurisdiction for land
use, building, and other municipal services. The proposed development is consistent with the
established residential character of the surrounding area and supports the City's goals of
providing additional housing within the existing urban area.
The City of Eugene's annexation materials specifically recognize annexation as the process by
which property within the Urban Growth Boundary may be brought into the City, and the City's
River Road —Santa Clara planning materials recognize that voluntary annexation frequently
occurs when property owners seek to develop residential property located within the UGB but
outside the existing city limits.
B. Subject Site

The subject property is located at 134 Elkay Drive in Eugene, Oregon 97404. Publicly available
property information identifies the property at 134 Elkay Drive as approximately 0.67 acres, or
approximately 29,185 square feet, and identifies the existing use as residential. The property is
currently served by public water and public sewer.
The property is located in the River Road —Santa Clara area and is surrounded by established
residential development. The existing residential use and proposed duplex are consistent with
the residential character of the neighborhood.
The proposed annexation does not include a request for commercial or industrial development.
The intended future use is residential rental housing consisting of two dwelling units.
II. Annexation — Approval Criteria
Annexation approval criteria are established in Eugene Code Section 9.7825. The following
findings address the applicable criteria.
9.7825(1) — Urban Growth Boundary and Contiguity
The land proposed for annexation is within the City's Urban Growth Boundary and is
contiguous to the City limits.
Response:
The subject property is located within the Eugene Urban Growth Boundary. The property is
currently outside the Eugene city limits and is proposed for voluntary annexation into the City.
The proposed annexation is consistent with the City's established approach to annexation in the
River Road —Santa Clara area, where property within the UGB may be annexed as part of an
owner's voluntary request, particularly in conjunction with proposed residential development.
The City states that annexations must be contiguous to the existing city limits or across the
street from the city limits.
The proposed annexation will establish a logical municipal boundary and incorporate the subject
property into the City in conjunction with its planned residential development.
9.7825(2) — Consistency with the Metro Plan and Applicable Refinement Plans
The proposed annexation is consistent with applicable policies in the Metro Plan and
applicable refinement plans.
Response:
The subject property is located within the Eugene portion of the metropolitan planning area and
the River Road —Santa Clara area. The proposed annexation is consistent with the City's
long-standing growth management framework, which provides for urban development to occur
within the Urban Growth Boundary and for property within the UGB to receive urban services
through annexation ultimately.
The proposed development will maintain the residential character of the property while
increasing the number of housing units available on the site. Development of a duplex on the
approximately 0.67-acre property represents an efficient use of land within the existing urban
area and provides an opportunity to add rental housing without extending development into
areas outside the established urban growth area.
The proposed use also supports the City's housing objectives by providing two additional
residential units in an established neighborhood. The proposed development will be subject to
applicable City development standards following annexation.
Metro Plan — Growth Management
The Metro Plan recognizes that land within the Urban Growth Boundary may transition from
urbanizable to urban through annexation when the minimum level of key urban facilities and
services can be provided in an orderly and efficient manner.
Response:
The subject property is already developed for residential use and is located in an established
residential area. Public water and public sewer service are available to the property.
Because the proposed development will occur on an existing residential property within the
established urban area, the annexation represents an efficient extension of the City's jurisdiction
rather than expansion of the urban area into undeveloped land outside the existing growth
boundary.
The proposed duplex will use existing transportation and utility infrastructure serving the
surrounding neighborhood. Any required improvements or connections associated with future
development will be reviewed through the City's applicable development and building permit
processes.
Metro Plan — Annexation and Urban Services
The Metro Plan's growth management policies support the eventual annexation of land within
the UGB and the provision of an appropriate level of urban services.
Response:
The subject property is already located in an area where urban services are available. Public
water and sewer serve the existing residential property.
Annexation will allow the property to be incorporated into the City's municipal service area and
developed in accordance with City standards. The applicant's proposed residential development
does not require the creation of a new urban service area or extension of urban development
beyond the established neighborhood.
River Road —Santa Clara Neighborhood Planning Area
The subject property is located within the River Road --Santa Clara area. The applicable
planning framework emphasizes maintaining a livable residential community while
accommodating housing needs and appropriate infill development.
Response:
The proposed duplex is compatible with these objectives. The development will provide two
residential units on an existing residential property and will increase the supply of rental housing
within an established neighborhood.
The proposal represents residential infill rather than outward expansion. The approximately
0.67-acre property provides sufficient land area for residential development while maintaining
the site's established residential character.
The development will be designed and reviewed under the City's applicable development
standards to address building placement, access, parking, stormwater, landscaping, utilities,
and other site considerations.
9.7825(3) — Minimum Level of Key Urban Facilities and Services
The proposed annexation will result in a boundary in which the minimum level of key
urban facilities and services can be provided in an orderly, efficient, and timely manner.
Response:
The subject property is located within an established residential neighborhood with existing
urban infrastructure and public services. The property's existing public water and sewer service
demonstrates the availability of key urban utilities to the site.
The proposed duplex will be required to comply with all applicable City standards for utilities,
transportation, stormwater, fire and life safety, and building construction as part of subsequent
development review.
The following summarizes the anticipated provision of key urban facilities and services.
Wastewater
The existing property is served by public sewer.
The proposed duplex will connect to and utilize the available public wastewater system in
accordance with City requirements. Any required sewer connection, capacity, or infrastructure
improvements will be addressed through the development and building permit process.
Stormwater
The proposed development will be required to comply with the City's applicable stormwater
management requirements.
The applicant anticipates that stormwater associated with the proposed duplex and any
associated improvements will be managed in accordance with City standards. Detailed
stormwater design will be provided as part of the subsequent development review.
Water
The existing property is served by public water.
The proposed duplex will utilize the existing public water system, subject to confirmation of
available capacity and any required connection or service improvements through the City's
development review process.
Electric Service
Electrical service is currently available in the surrounding developed area. The proposed duplex
will utilize existing electrical infrastructure, with any necessary service upgrades or connections
coordinated with the applicable utility provider.
Transportation
The property has frontage and access from Elkay Drive. The proposed development will use the
existing neighborhood transportation network.
The development will be reviewed for compliance with applicable City requirements for driveway
access, parking, emergency access, and any other transportation -related improvements.
The addition of two residential units is expected to generate a relatively limited amount of
additional traffic and can be accommodated within the existing residential transportation
network.
Solid Waste
Solid waste collection will be available to the property following annexation in accordance with
City requirements and applicable collection arrangements.
The proposed duplex will provide appropriate space and access for residential solid waste and
recycling collection.
Fire and Emergency Medical Services
Following annexation, the property will receive fire and emergency services through the City's
applicable service system. The proposed duplex will be designed and constructed in compliance
with applicable fire and life -safety requirements.
Emergency access and building requirements will be addressed through the building permit and
development review processes.
Police Protection
Following annexation, the property will be within the City of Eugene's municipal jurisdiction and
will receive police protection consistent with other properties within the City.
Parks and Recreation
Upon annexation, residents of the proposed duplex will have access to City parks and
recreation programs on the same basis as other Eugene residents.
The property is located within an established residential neighborhood with nearby parks and
recreational opportunities. Publicly available property information identifies Rosetta Place Park
as approximately one-half mile from 134 Elkay Drive.
Land Use Controls
Following annexation, the property will be subject to the applicable City of Eugene land use and
development regulations.
The proposed residential development will be reviewed for compliance with the applicable
zoning, development, building, access, parking, stormwater, landscaping, and other standards.
The City's land use code is intended to address, among other things, housing choice, compact
urban development, neighborhood livability, transportation options, and community
development.
Communications
Telecommunications and communication services are available throughout the Eugene area.
Existing providers can continue to serve the property, with any necessary connections
coordinated as part of future development.
Public Schools
The property is located within the Eugene 4.1 School District. Publicly available property
information identifies River Road/El Camino del Rio Elementary School, Kelly Middle School,
and North Eugene High School as the schools serving the surrounding area.
The addition of two residential units is not anticipated to create a significant demand beyond the
capacity of the existing school service area.
Ill. Relationship of Annexation to Proposed Development
The applicant is requesting annexation in order to facilitate the future development of the
property with additional residential housing.
The proposed project is an approximately 1,800-square-foot duplex containing two residential
rental units. The project will make more efficient use of an existing residential property while
maintaining the site's residential character.
The proposed development is consistent with the City's objectives of accommodating housing
within the established urban area and encouraging appropriate residential infill. Rather than
extending urban development into new areas, the proposal places additional housing on an
already developed residential property where public water and sewer services are available.
Annexation is therefore a logical and efficient step in preparing the property for future
development. The applicant intends to complete the appropriate City development review and
building permitting processes following annexation.
No development is proposed as part of the annexation itself. The future duplex will be subject to
all applicable City requirements at the time development applications are submitted.
IV. Conclusion
The proposed annexation of 134 Elkay Drive is a voluntary request to bring an existing
residential property within the Eugene city limits. The property is located within the Eugene
Urban Growth Boundary and the River Road —Santa Clara area and is already served by public
water and sewer.
The annexation will facilitate the appropriate future development of the property with an
approximately 1,800-square-foot duplex containing two rental housing units. The proposal
represents residential infill within an established neighborhood, makes efficient use of existing
urban infrastructure, and adds housing without expanding the Urban Growth Boundary.
The minimum level of key urban facilities and services can be provided to the property in an
orderly, efficient, and timely manner. The future development will be reviewed for compliance
with all applicable City standards through the City's development and building permit processes.
Based on the information presented above, the proposed annexation is consistent with the
applicable annexation approval criteria and the City's growth management framework. The
applicant respectfully requests approval of the annexation of 134 Elkay Drive into the City of

Police services - Police protection can be extended to this site upon annexation
consistent with service provision throughout the city. Police currently travel along River
Road to provide service to areas throughout the River Road and Santa Clara area. Infill
annexations and development in this area will increase the efficiency of service delivery
to this area.
Fire and emergency services (Please indicate which fire district serves subject property.)
Santa Clara - Fire protection services are currently provided to the
subject property by the Santa Clara Rural Fire Protection District.
X_ River Road - Fire and emergency services - Fire protection is currently
provided to the subject property by the River Road Water District under contract
with the City of Eugene. Upon annexation, fire protection will be provided directly
by the City of Eugene Fire & EMS Department.
Emergency medical transport (i.e., ambulance) services are currently provided on a regional
basis by Eugene, Springfield, and Lane Rural Fire/Rescue to central Lane County, including the
River Road and Santa Clara areas. After annexation, this service will continue to be provided by
the current provider. All ambulance service providers have mutual aid agreements and provide
back-up service into the other providers' areas.
Planning and Development Services -- Planning and building permit services are provided to the
area outside the city limits but within the urban growth boundary by the City of Eugene. This
service would continue after annexation.
EWEB (Eugene Water and Electric Board) currently provides water and electric service in the
Eugene area and can provide service to new development in the River Road and Santa Clara
area upon annexation. Some properties in northern Eugene receive electric service from EPUD
(Emerald People's Utility District). Some properties in south Eugene receive electric services
from the Lane Electric Cooperative; please note if this is the case for your property. For more
