The subject property is approximately 12.58 acres, vacant, and located within the City of Eugene’s Urban Growth Boundary (UGB); jurisdictional parent zoning is Eugene R-1 (Low-Density Residential) and R-2 (Medium-Density Residential) with an Urbanizable Land (UL) and Commercial Airport Safety Zone (CAS) zone overlays. The subject property is contiguous with the City of Eugene’s city limits, as detailed herein, and is a legal lot of record. The Metro Plan Designation is Medium Density Residential. For City staff review, this written narrative demonstrates how the proposal complies with the annexation approval criteria contained in the Eugene Code (EC) section 9.7825 Annexation – Approval Criteria. Additionally addressed is the applicable Metro Plan. Eugene Code and Policy language are indicated herein by bold and/or italic typeface; applicant responses indicated by plain type. EC 9.7825 Annexation – Approval Criteria. The city council shall approve, modify and approve, or deny a proposed annexation based on the application’s consistency with the following: 1. The land proposed to be annexed is within the city ’s urban growth boundary and is: a. Contiguous to the city limits; or b. Separated from the city only by a public right of way or a stream, bay, lake or other body of water. Response: The subject property maintains frontage on Crow Road. This section of Crow Road has been annexed into the city limits; therefore, the proposed annexation is contiguous to the city limits in compliance with EC 9.7825(1)(a) above. 2. The proposed annexation is consistent with applicable policies in the Metro Plan and in any applicable refinement plans. Response: The subject property is located inside the Metro Plan Boundary in the City of Eugene’s UGB. The proposed annexation is consistent with Metro Plan policies as they encourage compact urban growth in an effort to achieve efficient use of land and urban service provisions while maintaining the residential and mixed-use character of the area. Parent zoning for the subject property is Eugene R-1 and R-2 and the Metro Plan Designation is Medium-Density Residential. The UL zone overlay will automatically cease to apply upon approval of this proposal by the City Council and the resulting jurisdictional zoning and land use designation will be in congruence. The CAS zone overlay will remain and does not change the annexation proposal. There is no refinement plan that is applicable to the subject property. 3. The proposed annexation will result in a boundary in which the minimum level of key urban facilities and services, as defined in the Metro Plan, can be provided in an orderly, efficient, and timely manner. Response: The proposed annexation complies with EC 9.8725(3) as proximity to key urban facilities and services allows for the orderly, efficient, and timely provision of such amenities. Some utilities required to serve the subject property are located within the Crow Road right-of-way as shown on the accompanying annexation site plan. The following urban facilities and services are in place and readily available to the subject property proposed for annexation: Metro Planning, Inc. August 24, 2026 Page | 1 Annexation Application - Electric and water services are provided by EWEB. - Natural gas facilities are provided by Northwest Natural Gas. - Stormwater overflow will be directed to the existing public storm drainage system in Crow Road. - Zumwalt Rural Fire Protection District currently provides fire protection service to the area. Upon annexation, service will be provided by Eugene-Springfield Fire & Rescue. - Emergency Medical/ Ambulance services are currently provided by Eugene-Springfield Fire & Rescue. - The subject property has access to existing LTD service line 93 Veneta on nearby W 11th Ave providing transportation access from the north and south. - The properties are within Eugene School District 4J and are within the district boundaries of Twin Oaks Elementary, Kennedy Middle School and Churchill High School. Metro Plan Growth Management Policies Policy 8: Land within the UGB may be converted from urbanizable to urban only through annexation to a city when it is found that: a. A minimum level of key urban facilities and services can be provided to the area in an orderly and efficient manner. b. There will be a logical area and time within which to deliver urban services and facilities. Conversion of urbanizable land to urban shall also be consistent with the Metro Plan. Response: The proposed annexation complies with Metro Plan Growth Management Policy 8 as the subject properties can be served by more than a minimum level of key urban services immediately upon approval of annexation and in an orderly and efficient manner as this area is already urbanized. Urbanization of the residentially zoned subject property is congruent with the intention of the Metro Plan’s residential designation. The proposed annexation complies with Policy 8. Policy 10: Annexation to a city through normal processes shall continue to be the highest priority. Response: The applicant is utilizing the City of Eugene’s codified annexation application process to annex the subject properties into the City of Eugene’s city limits. The proposed annexation complies with Policy 10. Policy 15: Ultimately, land within the UGB shall be annexed to a city and provided with the required minimum level of urban facilities and services. While the time frame for annexation may vary, annexation should occur as land transitions from urbanizable to urban. Response: The subject properties are located within the City of Eugene’s UGB. The full range of urban facilities and services exist in this area of Crow Road as many nearby and/or adjacent properties have already transitioned from urbanizable to urban, having been previously annexed into the city’s jurisdiction. The proposed annexation of the subject properties comply with Policy 15. Policy A.2 Residentially designated land within the UGB should be zoned consistent with the Metro Plan, and applicable plans and policies; however, existing agricultural zoning may be continued within the area between the city limits and UGB until rezoned for urban uses. Metro Planning, Inc. August 24, 2026 Page | 2 Annexation Application Response: The Metro Plan Diagram indicates that the subject property is designated for Medium-Density Residential development. The subject property is currently zoned City of Eugene R-1 and R-2 with an Urbanizable Land (/UL) Zone Overlay and CAS Zone. Upon approval of the proposed annexation by the City Council, the properties will remain R-1 and R-2 consistent with its Metro Plan designation and the /UL Overlay will automatically cease to apply.
