Response to Findings and Decision of the Planning Director
Nick:
Thank you for your thorough staff report. The following are the responses to the Final Plat Application
Requirements, Conditions of Approval and Information Items. The City items are in regular typeface and
our responses are in italics.
EC 9.8235 Partition, Final Plat Application Requirements. In addition to the provisions in EC 9.7010
Application Filing, final plat applications shall:
(1) Be signed by the owner of the property.
The owners of the property have signed the application.
(2) Contain a proposed final plat stamped and signed by an Oregon licensed land surveyor,
complying with state and local platting and surveying requirements.
The final plat is stamped and signed by Kent Baker, Roberts Surveying, Inc., an Oregon
licensed land surveyor.
(3) Contain documentation addressing all conditions of tentative plat approval and state and
local platting requirements.
As demonstrated in this application, conditions of tentative plat approval and state and
local platting requirements have been met.
EC 9.8240 Partition, Final Plat Approval Criteria.
The planning director shall approve or deny the partition’s final plat. Approval shall be based
on compliance with the following criteria, unless specifically exempt from compliance through
a code provision applicable to a special area zone or overlay zone:
(1) The city surveyor has approved the final plat for compliance with applicable platting
requirements in accordance with state law.
The final plat is being submitted with this application to obtain this approval.
(2) Streets, bicycle paths, accessways, and alleys for public use have been dedicated
without any reservation or restriction other than reversionary rights upon vacation.
Not applicable.
(3) Public improvements as required by this land use code or as a condition of tentative plan
approval are completed, or:
(b) A petition for public improvements and for the assessment of the real property for the
improvements has been signed by the property owner seeking the partition and the
petition has been accepted by the city engineer.
A draft Irrevocable Petition for Public Improvements is submitted with this application
for review and approval by the city engineer. Once approved a final document will be
submitted signed by the client and notarized ready for recording.

(4) Public assessment, and fees with respect to the partition have been paid, or:
(a) A segregation of assessments and liens have been applied for and granted by the
city,
(b) An adequate guarantee in a form acceptable to the city manager has been provided
assuring the liens, assessments and fees will be paid prior to recording the final plat.
There are no liens or fees associated with the partition.
(5) All conditions of tentative partition approval have been met and the final plat substantially
conforms to the provisions of the approved tentative partition.

Conditions of Approval
1. The applicant shall submit an Irrevocable Petition for public improvements in Irvington Drive to
include adequate paving.
See attached Irrevocable Petition.
2. The applicant shall complete construction of a 5-foot-wide sidewalk in Stark Street along the entire
frontage of the subject property. However, in order to avoid damage to the sidewalk abutting Parcel 2,
construction of the sidewalk abutting Parcel 2 may be deferred to the building permit process.
The applicant will construct the portion of the sidewalk abutting Lot 1 on Stark Street. This has not yet
been completed.
3. The applicant shall submit an Irrevocable Petition for public improvements in Stark Street to include
street trees.
See attached Irrevocable Petition.
4. The applicant shall record a deed restriction that holds both parcels under common ownership until
the existing accessory structure has been removed, relocated to be entirely within the boundaries of
Parcel 1, or otherwise modified to comply with applicable setbacks and building code requirements.
Alternatively, the accessory structure can be demolished or relocated to Parcel 1, in which case,
common ownership of both parcels is not required.

INFORMATIONAL ITEMS & ATTACHMENTS
The following informational items are also provided for the applicant’s benefit:
Fire Marshall’s Office
· There is an existing fire hydrant on the west side of Stark Street between 345 and 3550 Stark.
· Future building permits will be reviewed for compliance with the Eugene Fire Code (EFC) for fire
apparatus access roads (EFC section 503 and Appendix D), premises identification (EFC 505), and
fire protection water supplies (EFC 507 and Appendix B). If it is determined that the fire apparatus
access and/or fire protection water supplies are inadequate, the use of one or more of the Uniform
Alternate Construction Standards (UACS) may be evaluated as a remedy.
Acknowledged and agreed.
Planning:
· This approval does not relieve the applicant of complying with applicable code provisions or Oregon
Revised Statutes, which may otherwise govern the development of the subject property.
· Properties within special service districts are typically withdrawn from said districts through the
Annexation Withdrawals process, which occur once per year and requires approval from the Eugene
City Council. Therefore, it is likely that the subject property will eventually be withdrawn from the
Santa Clara Water District and any other special service districts.

Public Works
· There is an existing reserve strip (Map and Tax Lot: 17-04-02-33-03400, Reception No: 2007-
080313) to be released prior to recording of the final plat.
· A plat check fee will be required at the time of final plat application. These fees are subject to change;
plat check fees will be assessed according to the fee schedule in effect when the final plat application
is submitted.
A final plat check fee was paid with this submittal.
· Lane County Surveyor’s Office is responsible for review of ORS 209. A separate copy of the final plat
and Lane County application fees must be submitted to Lane County Surveyor’s Office prior to the
first plat review.

· A current title report must be submitted with the final plat. The final plat must show all easements,
encumbrances and restrictions listed in the title report, and all owners or interest holders must sign
the Declaration or submit concurrences.
See attached title report. The final plat will show all easements, encumbrances and restrictions listed
in the title report. All owners will sign the Declaration.
· The final plat must show the relationship between the property boundary and the right-of-way
centerline monuments.

· If any public utility easements are shown on the final plat, the following restriction will be required to
be shown on the final plat in accordance with EC 9.6500(3): “No building, structure, tree or other
obstruction shall be placed or located on or in a Public Utility Easement.”
There are no public utility easements shown on the Final Plat.
· All City liens and assessments must be paid or segregated prior to final plat approval

· Taxes for the current year must be paid prior to recording of the final plat. The applicant should
contact the Lane County Surveyor’s office to make arrangements.
A Tax Work Up sheet has been submitted to Lane County Surveyor’s office.
Building & Permit Services
· If at the time of development the Eugene/Springfield Fire Marshall (or their designee) determines that
there is inadequate water supply, apparatus access, or both, to the site for the development of one
and two family dwellings that will be subject to the Oregon Residential Specialty Code, the Eugene
Building Official (or their designee) may require compliance with one or more of the fire suppression
or fire containment Uniform Alternate Construction Standards set out at OAR 918-480-0125(4) and
(5).

Eugene Water & Electric Board
· The Eugene Water and Electric Board (EWEB) has provided a referral which lists informational items
and states an electric service extension is required to serve the new Parcel 2. Future development on
Parcel 2 will require a separate connection to the EWEB water system. For ease of reference, the
EWEB referral is included as Attachment A.
Electric Comments
EWEB has overhead electric facilities on the north side and southeast corner of the property, and
underground electric facilities on the west side of the property. An electric service extension is required to

serve proposed parcel 2. Extension of electric facilities will be designed to meet the City of Eugene Utility
Permitting ordinances, land use ordinances, EWEB standards, and other applicable codes. The cost of
facility extension to this parcel will be borne by the requesting customer and executed under EWEB
policies and procedures at the time request for electric service is made. After EWEB provides the
customer with electric design, typically the electric service conduit and conductors are installed by
customer to current codes and EWEB specifications and inspected by EWEB. The applicant or their
representative should initiate a design with EWEB electric by contacting Distribution Engineering at 541-
685-7521 or DistributionEngineering@EWEB.org.

Water Comments
There is an existing 8” EWEB water meter main on the south side of Irvington Dr. and one service to 776
Irvington Dr. This lot is currently served by Santa Clara Water District. There is also an existing 6” water
main on the west side of Stark St. Each new parcel/dwelling will require a dedicated water service.
Please contact EWEB’s Building & Renovation services at (541) 685-7086 to initiate a new service
request.
EWEB water does not allow installation of any water facilities under “rain gardens” or any open drainage
structure within the right-of-way. Provisions within the design must be made to accommodate the
installation of water facilities (services & hydrants) at common lot corners. A minimum 5’ wide “utility
corridor” at service crossing and hydrant locations is required. State Drinking Water regulations (OAR
333-061-0050(10)) require a minimum separation between water and sewer lines of 10’ where they run
parallel to each other, unless the sewer line is located with 1.5’ of clearance lower than the water line then
the required separation is 5’. EWEB owned water facilities will be located in the right-of-way, or in a
minimum 7’ public utility easement (PUE) adjacent to the public right-of-way. Adherence to EWE Water
Design and Construction Standards will be required. EWEB Water recommends the developer contact
the Fire Marshall concerning fire protection requirements for building permits.

Right-of-Way Comments
Easements must be Public Utility Easements or EWEB Easements if they are to accommodate EWEB’s
electrical system.
If a Public Utility Easement is designated on the plat, the plat should include the customary note for
PUE’s: “No building, structure, trees, shrubbery or other obstruction shall be placed or located on or in a
public utility easement.”
If an EWEB Easement is designated on the plat, a separate EWEB Easement document will need to be
created by EWEB Property Management. This document will be recorded with the Plat. IN addition, if an
EWEB Easement is designated on the plat, EWEB requests that a Note be added to the plat stating:
“EWEB easements shall include EWEB and its joint users with whom it may contract. At no time shall any
building, structure, sign or other obstruction shall be erected or placed or located within an EWEB utility
easement area without prior written consent of EWEB.”
