The owner proposes to create two (2) new parcels out of one (1) Legal Lot identified as Assessor’s Map & Tax Lot 17-03-28-12- 02300, addressed 511 Honeysuckle Ln. (“subject property”). The subject property is approximately 0.48 acres in size and located on the west side of Honeysuckle Ln. The development site is located in the R-1 – Low Density Residential Zone. Frontage along Honeysuckle Ln is partially developed with curb and gutter, and sidewalks terminate at the south of the subject site. Sewer, water, power, and stormwater facilities are located in the Honeysuckle Ln. right-of-way. The site is currently developed with a Middle Housing Duplex per Building Permit Files # 26- 02693-01 and 26-02694-01. The owner is pursuing a 2-lot Minor Partition to create two Middle Housing Parent Lots. Two (2) Middle Housing Land Division applications have been submitted concurrent with this Minor Partition application. The Proposed Middle Housing Duplex Land Divisions will result in a total of 4 Middle Housing Duplex Child Lots for a total of 4 dwelling units. The following narrative demonstrates the proposal’s overall compliance with the applicable approval criteria contained in Eugene Code (EC) Chapter 9, specifically EC 9.8210 – Partition, Tentative Plan Application Requirements and EC 9.8215 – Partition, Tentative Plan Approval Criteria – General/Discretionary. PART III – EUGENE CODE DEVELOPENT STANDARDS Part III addresses compliance with applicable development standards in Eugene Code (EC). Each applicable development standard is listed below in bold italics followed by findings demonstrating compliance. EC 9.8210 Partition, Tentative Plan Application Requirements In addition to the provisions in EC 9.7010 Application Filing, the following specific requirements apply to partition tentative plan applications: (1) Applications are prepared by an Oregon licensed land surveyor and contain preliminary title report. The tentative plan was prepared by Kyle W Latimer, PE, PLS, with Udell Engineering and Land Surveying, LLC, an Oregon Licensed Surveyor whose license expires December 31, 2026. The required Preliminary Title Report is attached for review. (2) Applications include all contiguous property under the same ownership as the subject property, and are signed by the owner of the property. There are no contiguous lots under the same ownership as the subject property. The application is signed by the owner of the property. (3) The lot proposed to be divided in the partition application is a legal lot. As noted above Tax Lot 2300 is a Legal Lot of Record as the lot was created by deed signed prior to April 2, 1962 and described as further described in Reel 409, Instrument 511 (1951). No boundary changes have occurred since its creation in 1951. Please see the attached Property Description Card. Helikson – Minor Partition Tentative Page 6 of 15 Written Statement April 13, 2026 (4) If the proposal includes housing, the written statement submitted with the partition application shall clearly state whether the applicant is electing to use the discretionary approval criteria in EC 9.8215 Partition, Tentative Plan Approval Criteria – General/Discretionary instead of the approval criteria found in EC 9.8220 Partition, Tentative Plan Approval Criteria – Housing/Clear and Objective. This Minor Partition – Tentative application does not include housing. The owner is electing to use the General/Discretionary approval criteria found in EC 9.8215. (5) The written statement submitted with the partition application shall clearly state whether the applicant believes that the proposal qualifies for the expedited land division procedures in EC9.7900 through EC 9.7925, and whether the applicant is electing to use the expedited land division procedures in EC 9.7900 through EC 9.7925. The owner is electing to use the expedited land division procedures in EC 9.7900 through EC 9.9725. EC 9.8215 - Partition, Tentative Plan Approval Criteria – General/Discretionary. The planning director shall approve, approve with conditions, or deny a partition, with findings and conclusions. Approval, or approval with conditions, shall be based on compliance with the following criteria: (1) The proposed partition complies with all of the following: (a) EC 9.2000 through 9.4170 regarding applicable parcel dimensions and density requirements for the subject zone and any applicable overlay zones. Within the /WR Water Resources Conservation Overlay Zone or /WQ Water Quality Overlay Zone, no new lot may be created if more than 33% of the lot, as created, would be occupied by either: 1. The combined area of the /WR conservation setback and any portion of the Goal 5 Water Resource Site that extends landward beyond the conservation setback; or 2. The /WQ Management Area. The site is zoned R-1 with no applicable Special Areas or Overlay Zones. As such, the standards at EC 9.8220(1)(a)(1) & (2). above are not applicable to this application. The relevant R-1 Low Density Residential Zone criteria contained in EC 9.2750 and EC 9.2760 are addressed below: EC 9.2750 – Residential Zone Development Standards In addition to applicable provisions contained elsewhere in this code, the development standards listed in this section and in EC 9.2751 to EC 9.2777 shall apply to all development in residential zones. In cases of conflicts, standards specifically applicable in the residential zone shall apply. In cases of conflicts in this section between the general standards and the area- specific standards, the area-specific standards shall apply: As noted above, no housing is proposed with this Minor Partition – Tentative application. The existing Middle Housing Duplex on proposed Parcel 1 will remain post division, with a concurrent Middle Housing Land Division application submitted for review to separate the duplex Child Helikson – Minor Partition Tentative Page 7 of 15 Written Statement April 13, 2026 Parcels. The prior residential accessory structure on proposed Parcel 2 has been removed per City of Eugene Permit #26-00918-01. EC 9.2760 – Residential Zone Lot Standards In the R-1 zone, the minimum lot size for a standard lot is 4,500 square feet and 6,000 square feet for a flag lot, with a maximum lot size of 13,500 square feet for new partitions and subdivisions per EC 9.2760(5). Proposed Parcel 1 will be 10,285 square feet post division. Proposed Parcel 2 will be 10,125 square feet post division. Therefore, proposed Parcels 1 and 2 do not exceed the 13,500 square feet requirement and meet the lot area minimum requirement. A minimum of 50 feet of street frontage is required for interior lots and 25 feet for flag lot poles serving 2 or more parcels. Proposed Parcel 1 will have approximately 58 feet of frontage post approval. Proposed Parcel 2 will have approximately 58 feet of frontage post approval. As such, both proposed parcels will meet the minimum requirement as proposed. Proposed Parcel 1 will have an average lot width of 58.47 feet. Proposed Parcel 2 will have an average lot width of approximately 57.53 feet. Both proposed parcels comply with the minimum lot width of at least 50 feet. (b) EC 9.6800 through EC 9.6875 Standards for Streets, Alleys, and Other Public Ways. 9.6805 - Dedication of Public Ways There are no public accessways proposed with this tentative partition plan. If required by the City of Eugene, all requested dedications may be provided subject to sufficient evidence to support the required dedication. 9.6810 – Block Length No streets are proposed. Therefore, this criterion is not applicable. 9.6815 (2) – Street Connectivity Standards. The site fronts Honeysuckle Ln, a developed street with curb, gutter, and adjacent sidewalks. No streets or alleys are proposed with this partition plan. Therefore, these standards are not applicable. 9.6820 – Cul-de-sacs or Emergency Vehicle Turnarounds. No streets are proposed or required to be developed with this tentative partition plan. Therefore, this criterion is not applicable. 9.6830 – Intersections of Street and Alleys. No streets are proposed or required to be developed with this tentative partition plan. Therefore, this criterion is not applicable. 9.6835 – Public Accessways. Connection from Honeysuckle Ln is existing to site. There are no adjacent cul-de-sacs, adjacent sites that are undeveloped, publicly owned, or developed with an accessway that connects to the subject site that would require bicycle or pedestrian accessway be constructed to provide a Helikson – Minor Partition Tentative Page 8 of 15 Written Statement April 13, 2026 connection from this proposed partition There are also no public parks adjacent to the development site. As such, public accessways are not necessary as part of this Minor Partition – Tentative application. 9.6840 – Reserve Strips. There are no streets being proposed as part of this partition. Honeysuckle Ln is an existing public Right-of-Way. The general area surrounding the site is fully developed. Therefore, a reserve strip is not required. 9.6845 – Special Safety Requirements. Honeysuckle Ln is an existing, developed street. No new streets are proposed. Therefore, this criterion is not applicable. 9.6850 – Street Classification Map. Honeysuckle Ln abutting the subject property is classified as a Local Street on the City of Eugene Street Classification Map adopted by Ordinance No. 20181 and as amended by Ordinance thereafter. 9.6855 – Street Names. There are no new streets proposed nor required. Therefore, this criterion is not applicable. 9.6860 – Street Right-of-Way Map. Honeysuckle Ln is classified as a Local Street on the City of Eugene Street Right-of-Way Map. No amendment of the right-of-way map is requested or required. 9.6865 – Transit Facilities. These criteria are understood. 9.6870 – Street Width. Honeysuckle Ln at the subject property is classified as a Local Street on the City of Eugene Street Classification Map adopted by Ordinance No. 20181 and as amended by Ordinance thereafter. Based on the City of Eugene Street Right-of-Way Map, Local Streets are required to maintain a right-of-way minimum of 45-60 feet, depending on volume. Honeysuckle Ln at the site has a variable width between approximately 40-42 feet of right-of-way width. Should Staff find that additional right-of-way dedication is required along the Honeysuckle Ln frontage, a Condition of Approval is understood and warranted. Table 9.6870 requires a minimum paving width for Local Streets between 20-34 feet. Paving along the developed Honeysuckle Ln varies at the site from approximately 20-30 feet in width in compliance with this requirement. As such, no additional paving width is proposed. 9.6873 – Slope Easements. Because of terrain, slope easements may be required to facilitate the construction of streets and alleys and protect the structural integrity of the constructed roadway. Slope easements shall be granted in addition to the required street or alley width listed in Table 9.6870 Right-of-Way and Paving Widths. Helikson – Minor Partition Tentative Page 9 of 15 Written Statement April 13, 2026 There are no existing slope easements nor are any required based on the topography of the site. 9.6875 – Private Street Design Standards. No public or private streets are being proposed as part of this partition. This criterion is not applicable. (c) EC 9.6500 through EC 9.6505 Public Improvement Standards. 9.6500 – Easements. (1) The city may require the dedication of easements for wastewater sewers and other public utilities, and for access thereto for maintenance, of a sufficient width to meet the intended use, provided the city makes findings to demonstrate consistency with constitutional requirements. Existing easements are provided on the Tentative Partition Plan –, attached. All proposed easements as applicable are provided on the Tentative Partition Plat (1) sheet, attached. Should the City require additional easement dedications, revisions may be made to the proposed plan. (2) Easements may be required along lot or parcel rear lines or side lines, or elsewhere as necessary to provide needed facilities for present or future development of the area. This is understood. (3) No building, structure, tree, or other obstruction shall be placed or located on or in a public utility easement. Prior to approval of a final PUD, final site review plans, or final plats, there shall appear thereon a restriction showing compliance with this subsection. This is understood. 9.6505 – Improvements – Specifications. (1) Water Supply Water utility services are existing and provided by the Eugene Water and Electric Board according to their policies and procedures. Additional water lines as necessary to serve Parcels 1 and 2 can be designed and established at the time of future development. (2) Sewage The subject property is served by the City wastewater system in compliance with provisions in Chapter 6 of this code. Additional wastewater lines as necessary to serve Proposed Parcels 1 and 2 can be designed and established at the time of future development. (3) Streets and Alleys There are no streets proposed with this tentative partition plan. This criterion is not applicable. Helikson – Minor Partition Tentative Page 10 of 15 Written Statement April 13, 2026 (4) Sidewalks No sidewalks currently exist along the frontage of the site. Should Staff find that sidewalks be required as part of future development along the Honeysuckle Ln frontage, a Condition of Approval is understood and warranted. (5) Bicycle Paths and Accessways No bicycle paths or accessways are being proposed as part of this Minor Partition – Tentative application. Existing bicycle and pedestrian facilities are located within the Harlow Rd right-of-way approximately 890 feet to the north. (d) EC 9.6706 Development in Flood Plains through EC 9.6709 Special Flood Hazard Areas – Standards. The site is located in FEMA Flood Hazard Zone X, Areas to be determined outside of 500-year flood. Therefore, these criteria are not applicable. (e) EC 9.6710 Geological and Geotechnical Analysis. This application is for a Tentative Partition Plan. Additionally, no public streets, alleys, drainage, or wastewater systems are proposed or required. Therefore, these criteria are not applicable. (f) EC 9.6735 Public Access Required. (1) Except as otherwise provided in this land use code, no building or structure shall be erected or altered except on a lot fronting or abutting on a public street or having access to a public street over a private street or easement of record approved in accordance with provisions contained in this land use code. Both proposed parcels will have frontage on Honeysuckle Ln in compliance with this standard. (2) Access from a public street to a development site shall be located in accordance with EC 7.420 Access Connections – Location. If a development will increase the development site’s peak hour trip generation by less than 50% and will generate less than 20 additional peak hour trips, the development site’s existing access connections are exempt from this standard. The proposed partition will create two new R-1 parcels; no development is proposed as part of this application. Per Institute of Transportation Engineers (ITE) Manual 11th Edition, one R-1 lot creates about one (1) peak hour trip. Therefore, the proposal can be expected to add two (2) additional peak hour trips, doubling the potential peak hour trips. EC 7.420 Access Connections – Location is addressed below to demonstrate compliance with EC 9.6735. 7.420 Access Connections – Location. (1) Access Connections to all Street Classifications. Access connections to all street classifications shall be located in accordance with the following standards: Helikson – Minor Partition Tentative Page 11 of 15 Written Statement April 13, 2026 (a) No access connection shall be located to encompass a municipal utility. An access connection may encompass a municipal utility if the applicant either: 1. Executes a public utility easement for the encompassed municipal utility; or 2. Agrees to accept financial responsibility for relocating and/ or adjusting the encompassed municipal utility. The existing access location does not encompass a municipal utility. This criterion is not applicable. (b) Except when an existing lot or parcel frontage is located entirely within an area where the adjacent street grade is over fifteen percent (15%), no access connection shall be located in areas where the street grade is over fifteen percent (15%). If an existing lot or parcel frontage is located entirely within an area where the existing street grade is over fifteen percent (15%), one access connection may be permitted at the point of lowest grade percentage. The site is predominantly flat and there are no areas of the site that exceed fifteen (15%) grade. This criterion is not applicable. (c) If a parcel has frontage on two or more streets of different street classifications, the access connection shall access the street with the lowest classification. The access connection can access the street with the higher classification if the applicant can demonstrate (1), (2) or (3): The subject property does not have frontage on more than one street. This criterion is not applicable. (d) Access connections located within five feet of an existing alley connection may be merged with the alley pavement. The combined connection width shall not exceed 35 feet. A public access easement shall be recorded and submitted to the city upon issuance of a permit to construct the access connection. The access location for the subject property is not located within five feet of an existing alley. This criterion is not applicable. (2) Access Connections to Arterial and Major Collector Streets. In addition to the standards set forth in this EC 7.420(1), access connections to arterial and major collector streets shall be located in accordance with the following standards. As noted above, Honeysuckle Ln is classified as a Local street. Therefore, these standards are not applicable. (3) Access Connections to Local and Neighborhood Collector Streets. In addition to the location standards set forth in EC 7.420(1), access connections to local and neighborhood collector streets shall be located in accordance with the following standards: Helikson – Minor Partition Tentative Page 12 of 15 Written Statement April 13, 2026 (a) Lots and parcels at intersections shall have the access connection begin no less than 20 feet from the end of the radius of the curb, or 20 feet from the property corner if there is no curb. The site is not located at or near an intersection. Therefore, this standard is not applicable. (b) A safety island of not less than 22 feet of full height curb shall in all cases be provided between access connections under one ownership. This is understood. However, only one shared access connection is proposed for the site for the benefit of proposed Parcels 1 and 2, and each proposed Middle Housing Duplex Lot associated with the concurrent submittal. (g) EC 9.6750 Special Setback Standards. The right-of-way of Honeysuckle Ln abutting the site is variable in width, ranging from approximately 40-42 feet. Which is approximately 3 feet short of the minimum right-of-way width of 45 feet per the City of Eugene Right-of-Way Map. Should Staff find that special setback is required along the Honeysuckle Ln frontage, a Condition of Approval is understood and warranted. (h) EC 9.6775 Underground Utilities. Two concurrent Middle Housing Land Division applications have been submitted for proposed Parcels 1 and 2, with each parent site consisting of two Middle Housing Duplex dwellings. As such, all future development will be designed in compliance with the minimum standards at the time of building permit submittal. (i) EC 9.6780 Vision Clearance Area. The site is an interior lot. Therefore, this criterion is not applicable. (j) EC 9.6791 through 9.6797 regarding stormwater flood control, quality, flow control for headwaters area, oil control, source control, easements, and operation and maintenance. No new development is proposed. All future development will be designed in compliance with the minimum stormwater control, quality, and flow standards. (k) All other applicable development standards for features explicitly included in the application. The following information has been included here demonstrating compliance with the following applicable development standards: 9.6792(3)(c) Stormwater Quality. This is understood. As plans for development are conceptual at this time, a stormwater quality facility to treat the runoff from any proposed shared driveway will be selected from the Stormwater Management Manual at the time of submittal of a development permit. However, a conceptual stormwater plan is included in this application for reference. Helikson – Minor Partition Tentative Page 13 of 15 Written Statement April 13, 2026 9.6815(2) Street Connectivity Standards. 2(a): No new streets are proposed. This standard is not applicable. 2(b:) The development is in a fully gridded neighborhood with no ability to connect to the existing streets within ¼ mile. 2(c): There are no undeveloped or partially developed lands adjacent to the development site. 2(d): Secondary Fire and Emergency have access from Honeysuckle Ln 2(e): No streets are proposed with this application. 2(f): No street connections are proposed or needed. 2(g): The owner respectfully requests an exception to the standards of (2)(b), (c) and (d) based on 2(g)(2)(b). (l) The applicable adopted plan policies beginning at EC 9.9500. No adopted plan policies beginning at EC 9.9500 are applicable to this application. An approved adjustment to a standard pursuant to the provisions beginning at EC 9.8015 of this land use code constitutes compliance with the standard. No adjustments are requested as part of this application. (2) The proposed partition will not cause any existing improvements on proposed lots to be inconsistent with applicable standards in this land use code. The proposed partition will not cause any existing improvements on proposed lots to be inconsistent with applicable standards in this land use code. As shown on the attached Tentative Partition Plan, the proposed boundary between Parcel 1 and 2 will not result in a non-compliant setback for the existing Middle Housing Duplex. (3) Partitions abutting collector and arterial streets comply with access management guidelines of the agency having jurisdiction over the street. As noted throughout this Written Statement, the site does not abut a collector or arterial street. Therefore, this criterion is not applicable. (4) If the provisions of EC 9.8220(1) require a public street, or if the applicant proposes the creation of a public street, the following criteria also apply: A new public street is not required or proposed with this Minor Partition – Tentative Plan. (5) As far as is practicable, lot side lines run at right angles to the street upon which the lots face, except that on curved streets they are radial to the curve. All proposed lot lines are at right angles as far as practically possible. (6) On R-1 zoned property, if the partition results in a parcel greater than 13,500 square feet in size based on EC 9.2761(5)(b), the application shall indicate the location of parcel lines and other details of layout that show future division may be made without violating the requirements of this land use code and without interfering with the orderly extension of adjacent streets, bicycle paths, and accessways. Any restriction of buildings within future street, bicycle path, and accessway locations shall be made a matter of record in the tentative plan approval. Helikson – Minor Partition Tentative Page 14 of 15 Written Statement April 13, 2026 No resulting Parcel will be greater than 13,500 feet in area. Therefore, this criterion is not applicable. (7) If the applicant elects to use the expedited land division procedures in EC 9.7900 through EC 9.7925, the application must meet the following additional approval criteria in subparagraphs (a)–(c): This application elects to use the expedited land division procedures in EC 9.7900 through 9.7925 (a) The proposed partition only includes land zoned for residential uses; As noted above, the site is zoned R-1 Low Density Residential. (b) The parcels created will only be developed for residential use, including recreational or open space accessory to residential use; and Two Middle Housing Duplex Land Division applications have been submitted concurrent with this Minor Partition – Tentative application. As a requirement of the Middle Housing Land Division criteria at EC 9.8194 (6) and (8)(b), each Middle Housing Lot may only contain one Middle Housing Dwelling. As such, the parcels created as part of this Minor Partition application will only be developed for residential use, and a note will be added to the recorded Middle Housing Land Division Plat requiring the residential only development. (c) The parcels created will either allow construction of residential units at a density of 80 percent or more of the maximum net density per acre permitted in the zone and identified in Table 9.2750; or, existing and future dwellings located on the property that is the subject of the partition application will be sold or rented to households with incomes below 120 percent of the median family income for Lane County. As noted above, two (2) Middle Housing Duplex Land Division applications have been submitted concurrent with this Minor Partition – Tentative application. The Duplex Lots will not be subject to a maximum net density per acre, per EC 9.2751(1)(b). Therefore, the proposed parcels will allow construction of residential units at a density of 80 percent or more of the maximum net density per acre permitted in the zone and identified in Table 9.2750. Helikson – Minor Partition Tentative Page 15 of 15 Written Statement April 13, 2026 PART IV – CONCLUSION The proposed Partition, Tentative Plan application complies with applicable Eugene Code approval criteria or can be made so with appropriate and reasonable Conditions of Approval. The Written Statement, Attachments, and Tentative Partition Plan provide substantial evidence to support approval of the application.
