<br />Hearings Official Decision (PDT 24-1; ST 24-3) 1 <br />DECISION OF THE HEARINGS OFFICIAL <br />FOR THE CITY OF EUGENE, OREGON <br />REQUEST FOR <br />PUD AND SUBDIVISION APPROVAL <br /> <br />Application File Name (Number): <br />Braewood Hills 3rd Addition (PDT 24-1 and ST 24-3) <br /> <br />Application Summary: <br />Request for approval of a tentative planned unit development (PUD) and subdivision to create 39 <br />residential lots located on the east side of Hawkins Lane and northeast of Randy Lane <br />(Assessor’s Map /Tax Lot 18-04-11-12 / 00200) <br /> <br />Applicant/Owner: <br />Picullel Properties, LLC <br /> <br />Applicant’s Representatives: <br />Carol Schirmer, Schirmer Consulting, LLC <br />Bill Kloos, Law Office of Bill Kloos PC <br /> <br />Lead City Staff: <br />Nicholas R. Gioello, Associate Planner <br /> <br />The following findings and conclusions are based upon testimony presented at the public hearing <br />held on July 10, 2024 and all documents in the Eugene City planning file for the requested <br />Braewood Hills PUD submitted before the close of the Record on August 21, 2024, including <br />documents submitted before, at and after the public hearing. <br /> <br />Conclusion: <br />The applicant’s request for approval of a residential planned unit development (PUD) and <br />subdivision is denied and subject to potential amendment under ORS 197.522. <br /> <br />A. Background <br /> <br />The applicant, Picullel Properties, LLC (applicant) submitted the subject tentative PUD and <br />subdivision application on March 29, 2024. The applicant submitted supplemental application <br />materials on May 10, 2024. The City deemed the application complete on May 28, 2024. <br /> <br />Following public notice, a public hearing was held on July 10, 2024. The public hearing began <br />with the hearings official’s explanation of the hearing process and the statutory and local <br />procedural requirements for the hearing.1 Following the introductory explanation, Associate <br /> <br />1The hearing official’s explanation included a statement that she has had no ex parte contacts regarding the <br />applications and has no personal or financial interest in the subject property.
