Am- • - Planning The purpose of this notice is to give you a chance to learn about land use changes being proposed in your area and how to comment on the proposed changes. You may also want to share this information with others in your neighborhood. What Is a Public Hearing? A public hearing is an opportunity for community members to provide comments on the proposed land use changes described above. These comments will go to a Hearings Official who will consider them in their decision. The Hearings Official's decision whether or not to approve the proposed land use changes are based on applicable approval criteria outlined in the City's land use code. What are the Approval Criteria? As part of the review process, land use changes are reviewed for compliance with specific approval criteria (criteria are the standards or rules that a decision maker uses to base a decision). For a Zone Change, the applicable approval criteria are found at Section 9.8865 of the Eugene Code. The applicable adopted plans are the Eugene- Springfield Metropolitan Area General Plan (Metro Plan) and the River Road / Santa Clara Urban Facilities Plan. The Eugene Code is available to view at the Eugene Planning Division, 99 West 10th Avenue or online at httwww.eueene-or.gov/citycode (for the code) and http://www eugene-or gov/848/Studies-Adopted-Plans- and- Archives (for plans). *IMPORTANT NOTE: In Response to COVID-19, meetings will continue to be held remotely using a virtual meeting technology until further notice. How to Comment on the Proposal ❖ Submit a written statement to the Hearings Official, c/o Nick Gioello, Associate Planner, Eugene Planning Division, 99 West 10th Avenue, Eugene Oregon 97401 or via email NGioello@eugene-or.gov ahead of the day and time of the hearing. ❖ Attend the public hearing and state your concerns. At the hearing, the Hearings Official will ask for (1) testimony that supports the request, (2) testimony that neither supports nor opposes the request, and (3) testimony that opposes the request. Instructions to provide testimony at the appropriate time will be provided during the hearing and the hearing will be recorded. ❖ Contact your neighborhood organization to discuss this proposal. This application falls within the boundaries of the River Road Community Organization. If a participant requests an additional opportunity to submit testimony, the City will accommodate that request either by continuing the hearing on another date or by holding the record open for more written testimony. The Hearings Official will issue a written decision on the application, after the public hearing and closure of the public record, as required by the Eugene Code. The Hearings Official will not make a decision at the public hearing. The applicable procedures for this Type III application are primarily addressed at Sections 9.7300-9.7340 of the Eugene Code. The Hearings Official's decision can be appealed to the Eugene Planning Commission. Keep in mind that failure to raise an issue at the public hearing, in person or by way of written testimony, or failure to provide statements or evidence with sufficient specificity to enable the Hearings Official to respond to the issue, precludes an appeal based on that issue. Only those issues raised by testimony, oral or written, as part of the initial hearing process may be raised in subsequent appeals (to the Eugene Planning Commission, then to the State Land Use Board of Appeals).
