In accordance with the Zone Change submittal requirements, this written statement describes the
proposed zone change and demonstrates that the proposal complies with the Zone Change criteria under
the Eugene Code Section (EC) 9.8865. The proposal is subject to the Type III application review process
per EC 9.7300 through 9.7340.
1. Land Use Request
The applicant requests a zone change from the Low Density Residential (R-1) zone to the Public Land
(PL) zone. Currently, the site is developed with a one-unit residential dwelling, associated driveway,
landscaping, and other site improvements.

II. Site Description
A. Location and Site Context
This zone change request applies to the entirety of Tax Lot 2000 on Lane County Assessor's Map 17-04-
24-23 (the "site"), which totals about 0.11 acres or 4,781 square feet. The site is located at 148 West
Hilliard Lane, and it abuts the existing River Road/El Camino del Rio Elementary School to the east. The
site is on the south side of Hilliard Lane. It is approximately 1,200 feet west of River Road.
The site is located within the Eugene City Limits and Urban Growth Boundary per the Envision Eugene
Comprehensive Plan. On the Metro Plan diagram, the lot is designated Low Density Residential (LDR).
The River Road-Santa Clara Urban Facilities Plan (RRSCUFP) also designates the site LDR (see
attachments). The site is zoned R-1. The abutting properties to the west and across Hilliard Lane to the
north are designated LDR and zoned R-1. The abutting lot to the east and south is home to the existing
River Road/El Camino del Rio Elementary School. That lot is designated Government and Education and
zoned PL.
B. Existing Conditions
The site is relatively flat and developed with a single-unit dwelling, gravel driveway, landscaping,
associated infrastructure.
The FEMA Flood Insurance Rate Map 41039C1 128F shows the site and surrounding properties are
within Zone X, which are areas determined to be outside the 500-year floodplain (see attachments).
The Eugene 2035 Transportation System Plan (TSP) classified Hilliard Lane as a local street. There is
existing Lane Transit District (LTD) service on River Road in routes 51 and 52. There are sidewalks along
the abutting school frontage that extend eastward to provide a pedestrian connection to River Road.
III. Relevant Land Use History
The 4,356 square foot site is developed with an existing one-unit residential dwelling and a detached
garage. The existing 1,374 square foot dwelling was constructed in 1947.
A single prior land use application is associated with the site. An Annexation application (City file no. A
22-5) was filed in 2022. The Eugene City Council approved the application on June 13, 2022. The local
approval resulted in the site being incorporated and the zone changed from R-1/UL to R-1.

IV. Approval Criteria - Zone Change Supporting Facts and Findings
This section is organized by the applicable approval criteria per EC 9.8865. Applicable approval criteria
are outlined in bold italics below, followed by proposed findings in normal text.
EC 9.1060 - Changes In Zone Boundaries And Overlay Zone Boundaries.
Unless automatically changed upon annexation pursuant to EC 9.7820, Changes in zone
boundaries or overlay zone boundaries shall be processed pursuant to the Type 111
Application Procedures (EC 9.7300 - 9.7340) or, if processed concurrently with a refinement
plan or code amendment, Type IV Application Procedures (EC 9.7400 - 9.7455). Decisions
shall be based on the criteria contained in EC 9.8865 Zone Change Approval Criteria
Finding: As stated above, the Metro Plan Diagram designates the subject property LDR. The River Road-
Santa Clara Urban Facilities Plan Land Use Diagram also designates the site LDR. The zone was
automatically changed upon annexation from R-1/UL to R-1. The proposed zone change from R-1 to PL
remains consistent with the LDR designation in the adopted plans, and no concurrent plan or code
amendments are proposed. Therefore, the subject application shall be processed as a Type III
application and shall address the criteria in EC 9.8865.
EC 9.8865 - Zone Change Approval Criteria.
Approval of a Zone Change application, including the designation of an overlay zone, shall
not be approved unless it meets all of the following criteria:
(1) The proposed change is consistent with applicable provisions of the Metro Plan. The
written text of the Metro Plan shall take precedence over the Metro Plan diagram where
apparent conflicts or inconsistencies exist.
Finding: The Metro Plan is the guiding policy document for the Eugene-Springfield Metropolitan Area.
Under state law all implementing ordinances and regulations, including the Eugene Zoning Code, must
be consistent with the Metro Plan. The adopted Metro Plan Diagram designates the site as LDR. Per
Section II-G Metro Plan Diagram findings, the community recognizes that "approximately 32-percent of
the area is available for auxiliary uses" including streets, parks, or schools. The Residential designation
description states that "[s]uch auxiliary uses shall be allowed within residential designations if compatible
with refinement plans, zoning ordinances, and other local controls for allowed uses in residential
neighborhoods." This directive applies to all residential plan designations. The PL zone regularly
implements the Residential designation when applied to neighborhood schools across the city.
The auxiliary use finding is also incorporated into the Metropolitan Residential Land Use and Housing
Element findings.

8. In the aggregate, non-residential land uses consume approximately 32 percent of buildable
residential land. These non-residential uses include churches, day care centers, parks,
streets, schools, and neighborhood commercial.
The acknowledgement of auxiliary (or non-residential) uses in the findings is advanced in policy direction,
as follows.
A.22 Expand opportunities for a mix of uses in newly developing areas and existing neighborhoods
through local zoning and development regulations.
The proposed PL zone implements the residential plan designation directive above, is consistent with the
Metro Plan findings, and will further expand the mix of uses in the River Road community. Therefore, the
proposed zone change complies with the criterion.
(2) The proposed change is consistent with applicable adopted refinement plans. In the
event of inconsistencies between these plans and the Metro Plan, the Metro Plan
controls.
Finding: The applicable refinement plan is the River Road-Santa Clara Urban Facilities Plan (1987)
(RRSCUFP). The RRSCUFP Land Use Diagram designates the site Low Density Residential.
The RRSCUFP includes adopted policies in the Land Use Element and the Public Facilities & Services
Element. The Land Use Element has separate sections for general land use, residential land uses, and
discrete subareas within the plan area. The site is not located within one of the identified subareas.
Additionally, the Public Facilities & Services Element has a Schools section. There are no school policies
relevant to the proposed zone change.
There are no clearly relevant policy directives in the General Land Use or Residential Land Use sections.
The zone change does not conflict with the RRSCUFP Land Use Diagram and policies. Therefore, this
criterion is met.
(3) The uses and density that will be allowed by the proposed zoning in the location of the
proposed change can be served through the orderly extension of key urban facilities
and services.
Findin : The site of the proposed Zone Change is within the UGB and City limits, is currently developed,
and the necessary key urban facilities and services are currently available and can be extended into the
site (see the attached Existing Site Plan for details). As defined in the Metro Plan, these facilities and
services include City- or district-provided wastewater service, stormwater service, transportation, solid
waste management, water service, fire and emergency medical services, police protection, city-wide
parks and recreation programs, electric service, land use controls, communication facilities, and public
schools on a district-wide basis." The specific provider for each facility type and service is listed below.

Wastewater
The City of Eugene, as a member of the Metropolitan Wastewater Management Commission, provides
wastewater service to the site. See Existing Site Plan.
Stormwater
The City of Eugene provides stormwater service in the area, although the majority of Hilliard Lane lacks
improved infrastructure, including the segment nearest the site.
Transportation
The surrounding public streets are in the jurisdiction of and maintained by the City of Eugene and Lane
County. The adjacent segment of River Road is classified as a Major Arterial and Hilliard Lane is
classified as a Local Street. Also, as noted above, Lane Transit District provides bus service in the area.
Solid Waste Management
Solid waste collection is operated by private firms (e.g., Sanipac, Lane Apex, etc.) and the site is included
in the franchise territory managed by the City of Eugene.
Water and Electric Service
EWEB provides water and electric service to the site. Per the existing conditions plan, existing water
lines, overhead utility lines, and electric control boxes are available in the abutting street rights-of-way
and are connected to the existing building.
Fire and Emergency Medical Services
The Eugene-Springfield Fire Department provides fire and emergency medical services to the site.
Police Protection
The Eugene Police Department provides police protection to the site.
City-wide Parks and Recreation programs
The City of Eugene provides parks throughout the jurisdiction. Area parks include Rosetta Place Park,
Rasor Park, and segments of the Willamette Greenway. Recreation services are provided by the City of
Eugene, along with a range of private and non-profit entities (e.g., Kidsports).
Land Use Controls
The City of Eugene provides planning and land use controls within the jurisdiction, including this site.
Communication Facilities
Several private communication providers offer service throughout Eugene. Existing telephone lines and
other overhead utility lines are available in the abutting street rights-of-way. See Existing Site Plan.
Public Schools
Eugene School District 4J provides public schools in this area of the community. The site is within the
River Road/El Camino del Rio Elementary, Kelly Middle, and North Eugene High School zones.
Based on the summary of service provision above, this criterion is met.

(4) The proposed Zone Change is consistent with the applicable siting requirements set
out for the specific zone in:
(e) EC 9.2681 Public Land Zone Siting Requirements.
9.2681 Public Land Zone Applicability and Siting Requirements.
(2) Siting Requirements. In addition to the approval criteria in EC 9.8865 Zone Change
Approval Criteria, the subject site must be land owned solely by a public agency
or a non-profit organization established primarily to provide public uses listed in
EC 9.2682(1). When public land is sold for private development, the property shall
be rezoned according to the procedures for zone changes beginning with and
following section 9.8850 Purpose of Zone Changes.
Finding: Per EC 9.2681, Public Land Zone Applicability and Siting Requirements are applicable to the
proposed zone change. The siting requirements are limited to the property ownership status. The site,
Map and Tax Lot 17-04-24-23-02000, is owned solely by a public agency, Eugene School District 4J (see
attachments). Therefore, the proposed zone change is consistent with this criterion.
(5) In cases where the NR zone is applied based on EC 9.2510(3), the property owner shall
enter into a contractual arrangement with the City to ensure the area is maintained as a
natural resource area for a minimum of 50 years.
Findin : The proposed zone change does not include the application of the NR Natural Resources zone.
Therefore, this criterion is not applicable.
V. Additional Supporting Findings
Transportation Planning Rule
The Oregon Transportation Planning Rule (TPR), which is also known as Oregon Administrative Rule
(OAR) 660-012-0060, requires that local governments account for transportation impacts as part of any
process that proposes amendments to the comprehensive plan or the official zoning map. Per subsection
(9) of OAR 660-012-0060, the local government may find that an amendment to a zoning map does not
significantly affect an existing or planned transportation facility if all of the following requirements are met:
(a) The proposed zoning is consistent with the existing comprehensive plan map designation and
the amendment does not change the comprehensive plan map;
(b) The local government has an acknowledged TSP and the proposed zoning is consistent with
the TSP; and
(c) The area subject to the zoning map amendment was not exempted from this rule at the time
of an urban growth boundary amendment as permitted in OAR 660-024-0020(l)(d), or the
area was exempted from this rule but the local government has a subsequently acknowledged
TSP amendment that accounted for urbanization of the area.

Finding: As noted above, the Metro Plan accounts for auxiliary uses, such as schools, within the
residential land use designations. Both the existing R-1 zone and the proposed PL zone are consistent
with and effectively implement the LDR plan designation. The city has an acknowledged TSP (Eugene
2035 Transportation System Plan); thus, the proposed zone is consistent with the acknowledged and
adopted TSP. The land was not previously exempted from the TPR during an urbanization process to
amend the urban growth boundary. Despite the general consistency with the criteria, the applicant has
conducted a TPRA.
As addressed in the attached Zone Change Transportation Analysis by Chris Clemow, PE, of Clemow &
Associates, LLC., 4J does not propose to redevelopment the subject parcel at this time and any type of
future redevelopment is unknown. The property will continue to provide ancillary services to the existing
school and will not increase student capacity or site trip generation. Therefore, a single-family residence
is considered to be the reasonable worst-case development in both the current R-1 and the proposed PL
zone designations. The proposed zone change from R-1 to PL is not anticipated to result in a trip
generation increase and will not significantly affect any existing or planned transportation facilities. As
such, OAR 660-012-0060 requirements are satisfied without any additional transportation analysis.
Similarly, the proposed zone change from R-1 to PL does not trigger the need for a TIA per Eugene Code
Section 9.8670. Further, if at any time the School District plans to increase student capacity resulting in
the need for a TIA, the City Planning Division will be notified and an evaluation per Eugene Code will be
provided.
VI. Conclusion
Based on the information and findings contained in this written statement and supporting attachments,
the proposed zone change meets the criteria of approval contained in the Eugene Code. The applicant
requests that the Hearings Official approve the proposal as presented. Both the applicant and the
applicant's representative are available for questions, as necessary.

This letter presents transportation-related materials supporting the proposed property annexation and
zone change near the River Road Elementary School campus located at 148 W Hilliard Lane in Eugene,
Oregon. The following items are specifically addressed:

1. PROPERTY DESCRIPTION AND PROPOSED LAND USE ACTIONS
The subject property, described as tax lot 2000 on Lane County Assessor's Map 17-04-24-23, is addressed
148 W Hilliard Lane in Eugene. The property is 4,356 square feet in size and is currently developed with a
single-family residence that is used by the Eugene School District 4J (4J) to provide student support
services for the adjacent River Road/Camino del Rio Elementary School.
The property has been recently annexed into the City of Eugene. The Metro Plan and the 1986 River Road-
Santa Clara Urban Facilities Plan plan designations are both Low Density Residential (LDR), and the current
zone designation is low-density residential (R-1). To formally establish the student support programs, 4.1
is proposing a zone change from Low Density Residential (R-1) to Public Land (PL).
Metro Plan policies acknowledge that a certain amount of LDR land will be used for "auxiliary uses" such
as schools. However, because the adopted Eugene 2035 Transportation System Plan (TSP) included
assumptions based on the LDR plan designation and implementing R-1 zone designation, a traffic impact
analysis study (TIA) is necessary to address Transportation Planning Rule (TPR) criteria outlined in Oregon
Administrative Rule (OAR) 660 012-0060 to support the proposed PL zone designation.

The subject land use action does not contemplate specific property development. Rather, it contemplates
a zone change request addressing both TPR and City requirements. As identified in the Trip Generation
section of this analysis, reasonable worst-case development of the subject property does not trigger the
need for a TIA per Eugene Code Section 9.8670. Further, if at any time the School District plans to increase
student capacity resulting in the need for a TIA, the City Planning Division will be notified and an evaluation
per Eugene Code will be provided.
2. EXISTING AND PROPOSED CONDITIONS
The subject property is bordered by W Hilliard Lane to the north, River Road/Camino del Rio Elementary
School to the south and east, and a residential property to the west. The site is currently developed with
a single-family residence.
In the existing and proposed conditions, property access to the transportation system is to the north to
W Hilliard Lane. The site is well connected to the surrounding pedestrian and bicycle network in both the
existing and proposed conditions. The site is served by Lane Transit District (LTD) bus routes 51, 52, and
55 operating on River Road to the east of the site.
3. SITE DEVELOPMENT
Development Assumptions
The subject property is currently developed with a single-family residence which is considered to be the
reasonable worst-case development scenario in the current zone R-1 zone designation.
Based on owner-provided information, the property is proposed to be used for "wrap-around student
services", such as tutoring or counseling, which support the academic activities at the adjacent River
Road/Camino del Rio Elementary School. As such, the current and proposed property (building) use is to
provide ancillary school services and future property development or improvements will not add
classrooms or increase the student capacity of the existing elementary school.
Overall, the property is not proposed to be redeveloped and any type of future redevelopment is
unknown. Because the property will continue to provide ancillary services to the existing school and will
not increase student capacity or site trip generation, a single-family residence is considered to be the
reasonable worst-case development in the proposed PL zone designation.

Development Trip Generation
Trip generation was estimated using the Institute of Transportation Engineers (ITE) Trip Generation
Manual, 11th Edition, and practices from the ITE Trip Generation Handbook, 3rd Edition for the
reasonable worst-case development scenarios in the proposed and current zone designations. Trip
generation estimates are presented in the following table.

Trip generation estimated using the Average Rate for all Land Uses per the ITE Trip Generation Handbook, 31d Edition
recommended practice.
As identified in the table above, reasonable worst-case development in the proposed and current zone
designations is the same. As such, there is no trip generation increase.
Overall, the proposed zone change from R-1 to PL is not anticipated to result in a trip generation
increase and will not significantly affect any existing or planned transportation facilities. As such, OAR
660-012-0060 requirements are satisfied without any additional transportation analysis.
4. SUMMARY
The following conclusions and recommendations are made based on the materials contained in this
analysis.
