Willamette River Greenway Code Amendments Intensification of uses, changes in use, or developments require special consideration before being permitted within the boundaries of the Willamette River Greenway. Oregon Statewide Planning Goal 15 requires that regulations governing lands within the Willamette River Greenway be designed to protect, conserve, enhance, and maintain the natural, scenic, historical, agricultural, economic, and recreational qualities of lands along the Willamette River. Development, including the development of housing, is permitted within the Greenway but a Willamette Greenway permit is required prior to development. The proposed Willamette River Greenway Code Amendments are intended to provide a clear and objective set of approval criteria and standards for the review and approval of proposed housing development within the Willamette River Greenway, consistent with the requirements of ORS 197.307 and Goal 15. The amendments include changes to the City's existing Willamette Greenway permit procedures and criteria to establish a Type II land use application process and a clear and objective set of approval criteria available for proposed housing within the Willamette Greenway. The proposed amendments also include an adopted map showing a setback from the Willamette River applicable to proposed housing uses. Finally, the proposed amendments are supported by a Design Plan, as required by Goal 15. If the proposed amendments are adopted, an applicant proposing to develop housing within the Greenway will be able to choose to proceed under a set of new clear and objective standards and a Type II application process or choose to proceed using a Type III application process, which includes a public hearing, and the City's existing Willamette Greenway standards, located in sections 9.8800-9.8825 of the Eugene Code. The proposed code amendments will not change the adopted Willamette Greenway boundary, The Willamette River Greenway Code amendments support the Middle Housing Code Amendments (CA 21-1 / MA 21-1) by providing a clear and object process for the development of all housing, including middle housing, within the boundaries of the Willamette River Greenway. More information regarding the Willamette River Greenway Code Amendment project can be found here: https://www.eugene-or.gov/764/Land-Use-Code-Amendments Procedures & Approval Criteria Following this initial public hearing, the Planning Commission will deliberate and make a recommendation to the City Council. The City Council will hold a second public hearing, then deliberate and make the final decision on the proposed land use code amendments. These land use code amendments will be processed using the Type V land use application procedures in EC 9.7500-9.7560. The City Council will be the final local decision-maker on the application. Separate notice of the City Council public hearing will be provided. In making a recommendation on these proposed code amendments to the City Council, the Planning Commission will address the relevant approval criteria from the Eugene Code (EC) at 9.8065. Testimony and evidence submitted should be directed toward the applicable approval criteria from the Eugene Code noted above, or other criteria in the City's adopted plans or land use regulations or applicable state law that the person testifying believes to apply to the decision. To be included in the Planning Commission's packet for the March 8th public hearing, your statement must be received by staff no later than 5pm on February 25th, 2022. ➢ Submit a written statement to the address or email above after February 25th, 2022, but before the Planning Commission closes the public hearing. The Planning Commission will have less time to read written material submitted after February 25th prior to taking action on the request and forwarding their recommendation to the City Council. ➢ Attend the public hearing on March 8th, 2022 and provide spoken testimony. Your spoken testimony will be recorded. Instructions for providing testimony during the virtual public hearing will be provided during the hearing. The Planning Commission may limit the time for each speaker to a few minutes. You are encouraged to submit written testimony prior to the close of the public hearing if you have detailed comments you wish to make. All public testimony received by the Planning Commission will be forwarded to the City Council. As noted above, the City Council will hold a subsequent public hearing following the Planning Commission's recommendation before any final action is taken on the request.
