DECISION OF THE HEARINGS OFFICIAL <br />FOR THE CITY OF EUGENE, OREGON <br />ZONE CHANGE REQUEST <br />Applicant/File Name (Number): <br />Everyone's Market (Z 21-4) <br />Application Summary: <br />Zone change request for property located at 5045 Barger Drive (Map No./Tax Lot 17-04-16-33 <br />/3700&3800) from C-1 Neighborhood Commercial to C-2 Community Commercial <br />Applicant's Representative: <br />Greg Blackmore, <br />Blackmore Planning and Development Services, LLC <br />Lead City Staff: <br />Rodney Bohner, Associate Planner <br />The following findings and conclusions are based upon testimony presented at the public hearing <br />held on September 8, 2021, and all documents in the Eugene City planning file for the <br />Everyone's Market zone change request (Z 21-4) as of the close of the record on that date. <br />Conclusion: <br />The applicant's request for a zone change on the subject property from C-1 Neighborhood <br />Commercial to C-2 Community Commercial is approved. <br />DISCUSSION AND FINDINGS: <br />A. Background <br />A zone change application for the subject property was submitted to the City on May 14, 2021, <br />and deemed complete on July 22, 2021. Public notice was provided as required under EC 9.7315 <br />on August 9, 2021. A public hearing was held on September 8, 2021. The public hearing began <br />with the hearing officer's explanation of the process and statutory and local procedural <br />requirements for the hearing.' Senior Planner Althea Sullivan then provided a summary and <br />analysis of the application. Following the staff presentation, the applicant's representatives <br />presented testimony and indicated the applicant's agreement with the staff report. Two residents <br />who live near the subject property then provided public testimony, expressing their concerns <br />about negative impacts of possible development resulting from the zone change. Following staff <br />comment and applicant rebuttal, the record closed at the close of the public hearing. <br />' The hearing official stated that she has had no ex parte contacts regarding the application and has no personal or <br />financial interest in the subject property or the proposed development. <br />Hearings Official Decision (Z 21-4) <br />
