INTERNAL MEMORANDUM <br /> <br /> <br /> <br />To: City of Eugene and Walker Macy <br />From: Joe Parzych and Pollyanna Lind <br />– <br />Date: January 9, 2019 updated January 14, 2019 <br />Re: Eugene waterfront wetland and OHW permitting <br /> <br /> <br />This memorandum summarizes the permitting pathway proposed for wetlands and the Willamette <br />River in the vicinity of the Eugene Waterfront project. A wetland and OHW (Ordinary High Water) <br />delineation were performed in December, 2018 at the Willamette River – Eugene Riverfront left bank <br />project area. This delineation did not identify wetlands present within the project area. The survey did <br />delineate and map, with survey-grade equipment, the Willamette River OHW. Following the field <br />survey, Inter-Fluve consulted with agency personnel at USACE (Melanie Omeara) and Oregon DSL <br />(Lauren Brown, Charles Redon, and Peter Ryan) to determine a permitting pathway for aquatic <br />resources at the site. The following represents information obtained from these contacts that was used <br />to determine our next steps. <br /> <br />USACE: Because we did not identify wetlands within the study area, and all proposed work for the <br />project is outside (above) the delineated OHW, we are technically outside of USACE jurisdiction. This <br />means that the City of Eugene does not need anything from them to complete the project in regards to <br />wetlands or waters. Inter-Fluved proposed to apply for a “No Permit Required” letter from USACE <br />to have proof of compliance for stakeholders or other parties. According to USACE, people typically <br />get these letters for large projects that have a multitude of stakeholders or clients that require <br />concurrency from USACE. <br /> <br />DSL: Inter-Fluve will apply for a “No State Permit Required” letter from DSL, which includes filling <br />out the JARPA (Joint aquatic resources permit application). DSL can also provide a concurrence letter <br />for the wetland report. Inter-Fluve recommends pursuing the “No State Permit Required” letter. The <br />concurrence letter may be redundant, and will be applied for as well as needed. <br /> <br />Jan 10, 2019: <br />This information was presented to the City of Eugene at a project meeting. City personnel agreed <br />with the recommendations described above to apply for and pursue “No Permit Required from <br />USACE and “No State Permit Required” from DSL to prove compliance with state wetland regulatory <br />requirements. <br />Inter-Fluve will prepare these documents and supply them to Emily Proudfoot for submission to the <br />appropriate agencies. <br /> 1 <br />
