GIOELLO Nick <br />Nick, <br />Please add me to the list of "Interested Parties" to receive public notices for PDT 17-1 (Capital <br />Hill). <br />Also would you please document the revised deadlines for: <br />a) Public Hearing Notice <br />b) Staff report <br />c) Public Hearing <br />d) HO Decision <br />Schirmer did not actually request a specific "longer time period" after the application was deemed <br />complete to schedule the public hearing, per EC 9.7310. <br />H Nick: <br />Please postpone the sche;ulpd January 10 he2dng plus a tirne out from the 120 day cluck With a 70 day time out. <br />We anticipate the next hearing date would he PA arch 711, 018. <br />Instead, she seemed to agree to an additional extension to the deadline for the "Final Action" per <br />ORS 227.178(1) and (5). Those are not the same deadlines, and EC 9.7310 requires a written <br />agreement by the applicant for a longer time period for the hearing. <br />If Schirmer agrees to a "longer time period" that is 60 days plus the sum of her requested <br />extensions (170 days), then, by my calculation, she would be agreeing to a hearing as late as April <br />16, 2017. However, the record is not clear on this. <br />In any case, staff needs to make sure timeline adjustments are clear and conform to EC 9.7310 et <br />seq and ORS 227.178(1) and (5) and ORS requirements for notices. <br />Thanks, <br />Paul <br />1 <br />
