You are receiving this notice because you own a property that is 0.5 acres or larger in size and that is designated (planned) for Medium Density Residential use but is not zoned for medium density residential use. A property owner with this type of land could chose to rezone this land to the R-2 Medium Density Residential Zone in the future. While rezoning the land to R-2 is not proposed, as discussed in the letter sent to you on September 2, 2016 the City is proposing changes to the development standards in the R-2 zone as described below: Envision Eugene: Urban Growth Boundary Pro'ect (City Files CA 17-1 MA 17-1 RA 17-1 Z 17-2 The City of Eugene is proposing to take numerous actions related to its urban growth boundary ("UGB"), the boundary to which Eugene's city limits may eventually grow. State law requires that this UGB include enough space for 20 years of growth to meet Eugene's need for jobs, parks, schools and homes. As part of this proposal, the City is proposing to add new land to the UGB in two places and to make several changes to related plans and regulations, including: Ordinance #1 (Establish UGB Land for Employment, Parks, Schools): • Adoption of a digital map establishing the precise location of Eugene's UGB and adding more land to the UGB in the Clear Lake and Santa Clara areas to meet the City's long-term land needs for employment sites, a school site for the Bethel area, and community parks for the Bethel and Santa Clara areas. See reference map, below. • Assignment of land use designations and new zones to the land being added to the UGB to allow the land's current land uses to continue until the landowner proposes to establish the needed employment, park or school use identified for the land, and to protect particular natural resources on that land as identified in proposed amendments to the Water Resources Conservation Plan and the Water Quality Waterways Map. • Adoption of a new comprehensive land use plan that includes policies pertaining to economic development, transportation, and future monitoring of Eugene's land supply and demand, an "economic opportunities analysis" and a new inventory of Eugene's buildable lands for employment. • Amendments of public facilities and transportation plans to add projects needed to keep pace with 20 years of Eugene's growth. 0 Amendments to the current Eugene Land Use Code to establish the /CL Clear Lake Overlay Zone and stormwater regulations for the Clear Lake expansion area. • Adoption of the current Eugene Land Use Code to make it applicable to the two areas added to the Eugene UGB. Ordinance #2: (Land for Housing): • Amendments to the new comprehensive land use plan to adopt a "housing needs analysis" which demonstrates that no land must be added to Eugene's UGB to meet the City's need for housing, and a new inventory of Eugene's buildable lands for housing. • Amendments to the Eugene Land Use Code to increase the required minimum density from 10 to 13 dwelling units per net acre on lots that are 0.5 acre or larger in the R-2 Medium Density Residential zone, with some exceptions (e.g. housing for low income individuals). For more information, please visit the following website: http://www.eugene-or.gov/2987/Adooting-Our-Urban-Growth-Boundary Review Process The Eugene and Lane County Planning Commissions will consider the approval criteria below in making a recommendation to their elected officials (the Eugene City Council and the Lane County Board of Commissioners). Following the public hearing, at a separate meeting, each planning commission will deliberate and take action to make its own recommendation. The proposal will then be considered by the elected officials in a process that will include another public hearing. Applicable Criteria The proposed actions must be consistent with Chapter 197 of the Oregon Revised Statutes, Chapter 660 of the Oregon Administrative Rules, and the approval criteria as listed here and at http://www.eugene- or.gov/2987/Adopting-Our-Urban-Growth-Boundary, at the link "List of Approval Criteria." EC 9.7735 Metro Plan Amendments - Criteria for Approval. The following criteria shall be applied by the city council in approving or denying a Metro Plan amendment application: (1) The proposed amendment is consistent with the relevant Statewide Planning Goals; (2) The proposed amendment does not make the Metro Plan internally inconsistent. (3) When the city-specific local comprehensive plan also applies, the proposed amendment is consistent with the city-specific local comprehensive plan. EC 9.8065 Code Amendment Approval Criteria. (1) Is consistent with applicable statewide planning goals as adopted by the Land Conservation and Development Commission. (2) Is consistent with applicable provisions of the Metro Plan and applicable adopted refinement plans. (3) In the case of establishment of a special area zone, is consistent with EC 9.3020 Criteria for Establishment of an S Special Area Zone. EC 9.8424 Refinement Plan Amendment Approval Criteria. (1) The refinement plan amendment is consistent with all of the following: (a) Statewide planning goals. (b) Applicable provisions of the Metro Plan. (c) Remaining portions of the refinement plan. (2) The refinement plan amendment addresses one or more of the following: (a) An error in the publication of the refinement plan. (b) New inventory material which relates to a statewide planning goal. (c) New or amended community policies. (d) New or amended provisions in a federal law or regulation, state statute, state regulation, statewide planning goal, or state agency land use plan. (e) A change of circumstances in a substantial manner that was not anticipated at the time the refinement plan was adopted. EC 9.8865 Zone Chance Aoaroval Criteria (1) The proposed change is consistent with applicable provisions of the Metro Plan. The written text of the Metro Plan shall take precedence over the Metro Plan diagram where apparent conflicts or inconsistencies exist. (2) The proposed zone change is consistent with applicable adopted refinement plans. In the event of inconsistencies between these plans and the Metro Plan, the Metro Plan controls. (3) The uses and density that will be allowed by the proposed zoning in the location of the proposed change can be served through the orderly extension of key urban facilities and services. (4) The proposed zone change is consistent with the applicable siting requirements set out for the specific zone in: (s) EC 9.4776 /WQ Water Quality Overlay Zone Siting Requirements (only for the purposes of adding the overlay zone. See EC 9.4786.). (t) EC 9.4915 /WR Water Resources Conservation Overlay Zone Siting Requirements (only for the purposes of adding the overlay zone. See EC 9.4960.). Note: other subsections of EC 9.8865(4) are not applicable. EC 9.8074 Envision Eugene Comprehensive Plan Amendment. (1) The proposed amendment would be consistent with the Statewide Planning Goals. (2) The proposed amendment would be consistent with the Eugene-Springfield Metropolitan Area General Plan. (3) The proposed amendment would be consistent with the remaining portions of the Envision Eugene Comprehensive Plan. (4) The proposed amendment would not result in a deficit in the city's needed supply of employment or residential land, based on the most recently adopted and acknowledged employment land study or residential land study. Testimony and evidence of those testifying should be directed toward the applicable state laws or criteria (above), or other criteria that the person testifying believes to apply to the decision. All testimony received by the Planning Commissions will also be forward to the elected officials as part of their review process. How do I get involved? Prior to the hearing send an email to envisioneugene@ci.eugene.or.us or send a letter to the Planning Commission, c/o Envision Eugene, Planning Division, 99 W. 10th Avenue, Eugene, OR 97401. To be included in the Planning Commission packet, your e-mail or letter must be received by the Eugene Planning Division by 5:00 pm on Friday February 24, 2017. 2. Speak at the Planning Commissions' public hearing on March 7, 2017. The hearing is scheduled for 7:00 p.m. at Harris Hall, 125 East 8th Avenue, Eugene. Your spoken testimony will be recorded in the minutes of the hearing. The Planning Commission may limit the time for each speaker to a few minutes, so you are encouraged to also submit written testimony if you have detailed comments you wish to make.
